As Mr Parkes admitted the breach we found the charge proved.

Penalty:

Mr Parkes has a suspension pending, for an unrelated charge, which will end on March 24th. The suspension imposed today is to follow on from that date and includes the following race days:

26/3/16 Tauranga/Masterton
30/3/16 Matamata
31/3/16 Wanganui

Mr Parkes is suspended from the close of racing on March 24th up to and including racing on March 31st.

Facts:

Following the running of Race 4, Taylor Agriculture Maiden, an Information was lodged by Mr Goodwin under Rule 638(1) (d) in that J Parkes allowed his mount to shift in when not clear, after the post on the 1st round, and caused a check to MASTER JACK and tightening to AL MUNROE.

Mr Goodwin used the videos to highlight the incident. Mr Parkes jumped from a wide barrier on FIREBIRD FLYER and was soon seeking a more favourable position closer to the running rail. He could be seen looking to his inside and when a gap presented in front of MASTER JACK (J Riddell) he angled inwards to claim that space. Unfortunately Mr Parkes misjudged his position and was not sufficiently clear of MASTER JACK when he angled inwards. As a consequence Mr Riddell was checked and another runner (AL MONROE), up against the rail, experienced some tightening.

Mr Parkes had nothing to add.

Submissions for Penalty:

Mr Goodwin said Mr Parkes had incurred suspensions for careless riding in August and September of last year. He submitted this was a good record for one of the best jockeys in the country. In relation to today’s breach Mr Goodwin said the Stewards believed a suspension was the appropriate penalty but placed the severity of the breach below midrange.

Mr Parkes declined the invitation to present any submissions on penalty.

Reasons for Penalty:

In coming to a decision on penalty the committee adopted, as a starting point, a five day suspension as outlined in the Penalty Guide for Judicial Committees. Mr Parkes clearly looked to his inside a number of times before moving inwards. A gap presented in front on MASTER JACK which appeared large enough for Mr Parkes to take but due to a slight misjudgement he found himself not quite the required distance clear of that runner. If Mr Parkes had waited a fraction longer it was probable there would have been no interference. We assessed his degree of carelessness to be at the lower end.

We gave credit for Mr Parkes' admission of the breach and his record which we considered to be very good. Mr Parkes is a successful senior rider who does not often appear on careless riding charges.

Taking into account all of the submissions and applying the mitigating factors it was our opinion that a three day suspension was an appropriate penalty.
