As Mr Wilkinson admitted the breach the charge was found to be proved.
Penalty:
Mr Wilkinson was fined the sum of $200.
Charge:
Mr T Wilkinson was charged with a breach of Rule 613(c) in that he presented IVADAAD at the inspection area with excessively worn plates.
Facts:
Mr Neal read rule 613(c) which states: A person must not start or attempt to start a horse in a Race or trial (including a jump-out, or test for certification purposes with a horse): in plates having a sharp flange or sharp projection on the ground-bearing surface, or which are excessively worn or otherwise faulty or defective.
Mr Neal said that he was advised by the plating inspectors that the plates worn by IVADAAD were substantially worn. Mr Neal personally inspected the horse's feet and estimated that the plates had been on the horse for 6 weeks or longer. He found nails protruding from the outside of the hoof and told the committee that the plates were not in a fit condition to be raced in.
Mr Wilkinson said that he wasn't sure during the week if he was going to be starting IVADAAD at the races today. When he did decide to race the horse he called the farrier and asked him to put new plates on then horse. The farrier did not turn up to do so.
Submissions for Penalty:
Mr Neal said that Mr Wilkinson had not been charged with a breach of this rule before and submitted that a fine of $200 was an appropriate penalty.
Mr Wilkinson asked the committee to note the mitigating circumstances of the farrier not turning up to plate the horse.
Reasons for Penalty:
In coming to a decision on penalty the committee took into account all of the submissions. It was unfortunate that the farrier failed to attend to IVADAAD prior to the races however Mr Wilkinson did have the option of asking the raceday farrier to re-plate his horse. He did not do so despite knowing that the plates were in need of replacement. IVADAAD was subsequently scratched from running in race 7.
The commiittee imposed a monetary penalty of $200 which they believed was appropriate for these particular circumstances.
