At the conclusion of race 3 The Waterforce 3YO Mobile Pace an information was lodged by Stipendiary Steward Mr S Wallis alleging that Junior Horseman Mr C Ferguson (EL DIABLO) used his whip excessively over the concluding stages of the race.
Mr C Ferguson admitted the breach and was supported by Senior Horseman Mr A Beck at the hearing.
The rule reads 869(2)(a)
No horseman shall during any race
A) Use his whip in an unnecessary , excessive or improper manner.
Facts:
Stipendiary Steward Mr S Wallis showed the Committee several video clips of the alleged incident highlighting Mr C Ferguson's whip action over the concluding stages of the race.
Mr Wallis stated that Mr Ferguson began striking his horse prior to the home straight, counting up to twenty one strikes to the winning post.
Mr A Beck supporting Mr Ferguson disputed the twenty one strikes stating that it was difficult to determine the alleged two strikes prior to entering the home straight, from the video clips.
Reasons for Decision:
The Committee was satisfied that Mr Ferguson had committed a breach of the rule, by striking his horse twenty times from prior to the home turn to the winning post, which was supported by the video evidence.

Mr Wallis stated that Mr Ferguson was a busy Junior Horseman having had 265 lifetime drives and 120 drives this season, and had no previous breaches under this rule.
Mr Ferguson stated that he was a stable hand working for Mr McLellan and had limited financial resources.
Reasons for Penalty:
The Committee believed the breach was at the lower end of the scale.
In fixing penalty consideration was also given to Mr Fergusons admission of the breach and his clear driving record under this rule.
