As Mr Bayliss admitted the breach the Committee found the charge proved.

Penalty:

The Committee granted a deferment to Mr Bayliss’ suspension pursuant to Rule 1106(2).

Accordingly, Mr Bayliss had his license to ride in races suspended for a period to commence after racing on 26 November and conclude after racing on 3 December 2017 (5 National riding days).

Facts:

Following the running of race 6, Te Awamutu College 1580, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Coles, alleged that near the 300 metres Mr Bayliss angled his mount KANE out when not sufficiently clear of MARC ONE and KAURI COVE which were hampered.

Mr Bayliss acknowledged that he understood the Rule and confirmed his admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Williamson demonstrated the incident using the available video footage. He identified that Mr Bayliss was riding KANE forward as he went to improve across the heels of MASKOBI PEARL. He said that Mr Bayliss was not sufficiently clear which resulted in both MARC ONE and KAURI COVE being crowded. He said that although Mr Bayliss rode in a careless manner the incident was exaggerated due to runners on his inside shifting outwards.

Mr Bayliss accepted Mr Williamson’s interpretation of the incident. He said that he was riding in a competitive manner and his shift outwards was too sharp.

Submissions for Penalty:

Mr Coles produced Mr Bayliss’ Australian record and categorised it as average. He said to Mr Bayliss’ credit he admitted the breach, the level of carelessness was low and submitted a term of suspension in line with that would be appropriate.

Mr Bayliss advised that he had engagements at Te Rapa on 26 November and sought a deferment to any proposed suspension.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

When reviewing the video footage the Committee observed that Mr Bayliss angled his mount out near the 300 metres when not the required distance clear. This resulted in both MARC ONE and KAURI COVE being hampered when pushed wider on the track. The Committee deemed the carelessness was low range.

The Penalty Guide for Judicial Committees recommends that the starting point for low range carelessness is 6 National riding days.

There were no aggravating factors.

The mitigating fact was Mr Bayliss’ admission of the breach and a 1 day discount was applied.

Mr Bayliss’ Australian record was considered to be average and a neutral factor.
