The protest was upheld, and BRIGHT GLOW was disqualified from the race.

Consequent upon the disqualification, the amended result is as follows:

1st - NEVER MIND (7)
2nd - BAXTER (11)
3rd - FOREIGNER (3)
4th - SODS LAW (14)
5th I- DEAL INVASION (13)

It was ordered that stakes and dividends be paid in accordance with the amended result.

Facts:

At the conclusion of race 10, Stipendiary Steward, Mr Renault filed an Information instigating a protest against BRIGHT GLOW, driven by Mr I Cameron, placed 4th by the Judge, in breach of Rule 869(7B) on the grounds that Mr Cameron drove inside the track markers and gained an advantage.

The Judges’ official placings in this race were as follows:
1st - NEVER MIND (7)
2nd – BAXTER (11)
3rd – FOREIGNER (3)
4th – BRIGHT GLOW (1)
5th – SODS LAW (14)
6th – IDEAL INVASION (13)

Rule 869 provides as follows:
(7B) Where any horse or its sulky wheel moves inside the track marker line and gains an advantage the horse shall be disqualified from that race except where it is established that the breach was caused by interference by another horse or driver.

Submissions for Decision:

Mr Renault identified Mr Cameron driving (1) BRIGHT GLOW, in the trail behind MAJESTIC ACTION who had led the race but was tiring passing the 400 metres. Mr Renault pointed to Mr Cameron shifting his horse inside of the tiring MAJESTIC ACTION where he alleged there wasn’t enough room. He then slowed the video and had Mr Williams point to Mr Cameron’s inside wheel as it passed inside 4 pylons. Mr Renault then showed Mr Cameron improve his position 1½ lengths before he locked wheels with MAJESTIC ACTION entering the home straight.

Mr Renault stated this was a clear example of a breach of the Rule as BRIGHT GLOW had gained an advantage by having its sulky wheel inside the track marker line.

Mr Renault sought disqualification of BRIGHT GLOW from the race.

Mr Cameron stated that any advantage gained was nullified when he locked wheels, therefore he was not in a better position than had he waited for the passing lane. He said MAJESTIC ACTION had ran out which enticed him to try for the rails run but he said it moved back inwards and contributed to him crossing the marker line.

Reasons for Decision:

The Committee was satisfied, after hearing the evidence and viewing all video angles, that BRIGHT GLOW was in breach of Rule 869(7B) by gaining an advantage having its sulky wheel moving inside the pylons.

We could find no evidence that MAJESTIC ACTION contributed to the incidence or any other horse or driver.

The Committee therefore find it appropriate to uphold the protest and disqualify the horse from the race.
