Charge:

Following the running of Race 3, Addington Bakery 283 Lincoln Road Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Junior Driver, Miss A D Edmonds, alleging that Miss Edmonds, as the driver of EXPOSED in the race, used her whip excessively.

Miss Edmonds was present at the hearing of the information and she indicated that she admitted the breach. She was assisted at the hearing by Licensed Open Driver, Mr A M Butt.

Rule 869 provides as follows:
(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.

Facts:

Mr Ydgren showed a video replay of the final 200-300 metres of the race. He pointed out Miss Edmonds, driving EXPOSED, sitting outside the leader turning for home. The Stewards were alleging that, from that point, Miss Edmonds used her whip on approximately 20 occasions. Mr Ydgren said that, to Miss Edmonds’ credit, there were several discernible pauses in the run home but 20 times was too many, as Miss Edmonds had agreed.

The Committee noted that EXPOSED had finished in a dead-heat for 2nd placing.

Submissions for Penalty:

Mr Ydgren informed the Committee that Miss Edmonds had a clear record. He submitted that a fine of $200 was appropriate.

Mr Butt, on behalf of Miss Edmonds said that it was clear that Miss Edmonds had used her whip too many times. He submitted that the hits were “not overly hard” and, as Mr Ydgren had said, there had been several pauses up the straight. The breach was at the lower end of the scale, he submitted. Miss Edmonds was a Junior Driver who did not have many drives. He emphasised her clear record and her admission of the breach. Any fine does “hurt” a Junior Driver, he said.

Mr Ydgren told the Committee that Miss Edmonds has had 10 drives in the current season.

Miss Edmonds expressed a preference for a fine rather than a suspension.

Reasons for Penalty:

In determining penalty, the Committee took into account Miss Edmonds’ frank admission of the breach and her clear record. The Committee noted that that there were several brief pauses in her use of the whip and the Committee assessed the offending as being at the lower end of the scale. Finally, the Committee took into account that Miss Edmonds is a Junior Driver with limited means.
