Accordingly, Ms Wenn had her license to ride in races suspended for a period to commence after racing on 1 June and conclude after racing on 11 June 2016 (4 days).
Facts:
Following the running of race 2, PGG Wrightson Limited 1600, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Ms Wenn permitted her mount BOSTON HAVOC to shift outwards when not sufficiently clear crowding MODEL AYE which was checked near the 800 metres.
Ms Wenn acknowledged that she understood the rule and confirmed her admission of the breach. Mr N Harris assisted Ms Wenn at the hearing.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Oatham demonstrated the incident by using the available video footage. He identified Ms Wenn was following CALMBEFORETHESTORM and she elected to come around that horse near the 800 metres. He said in doing so Ms Wenn permitted her mount to continually shift out into the line of MODEL AYE. He identified this resulted in that horse being checked quite severely and it lost considerable ground.
Ms Wenn advised that she came back off the heels of CALMBEFORETHESTORM on the point of a corner. She added that her mount did not take the corner as well as it should have.
Mr Harris stated that Ms Wenn made an error of judgement when allowing her mount to continue forward on the bend. He added that Apprentice riders need to get their angles right when racing into a bend.
Submissions for Penalty:
Mr Williamson said that Ms Wenn had a clear record under this rule and Ms Wenn had recently returned to race riding. He said the level of carelessness was low to mid – range but the consequences were mid to high. He added collectively the breach was in the low to mid – range.
Ms Wenn informed the Committee that she had about 20 rides since her return to riding after a 2 year breakaway. Ms Wenn advised that she had no engagements in the next 7 days and any proposed suspension could start immediately.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. The Committee have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors were Ms Wenn’s admission of the breach and her clear record in relation to this rule for which she has been given credit. However, this has to be balanced against the consequences of Ms Wenn’s actions which resulted in MODEL AYE being badly hampered. The films showed that Mrs Allpress the rider of MODEL AYE was unbalanced in the saddle and the horse lost about 4 lengths as a result of the check. The carelessness was mid -range and the impact slightly higher.
In response to a question from the Committee, Ms Wenn confirmed that she has only ridden in the Auckland / Waikato region. Ms Wenn recognised the Central Districts dates would not be included in her penalty because she has no recent history of riding there.
After taking into account all the above factors the Committee considers an appropriate suspension was 4 days.
