As the breach was admitted the Committee found the charge proved.

Penalty:

Mr MacNab’s Amateur Rider’s Licence was suspended from the close of racing on 26 July up to and including 25 August 2018. This encompasses 3 Amateur Riders races.

Facts:

Following the running of Race 4 (LAWNMASTER AMATEUR), Information No.A8843 was filed with the Judicial Committee. It was alleged that Mr MacNab the Rider of EDDIE GILBERT had used his whip excessively prior to the 100m without the necessary respite.

Mr MacNab said that he understood the Rule and the charge and confirmed that he admitted the breach.

Rule 639(3)(b)(ii) provides:
A rider shall not:
(ii) strike a horse with a whip in a manner or to an extent which is excessive

The “Guidelines With Respect to Acceptable Use of the Whip” provides:
Without affecting the generality of Rule 638(3)(b) a rider may be penalised if their whip use is outside of the following guidelines:

Inside the final 600 metres of any Race, official trial or jump-out a horse may be struck with the drawn whip up to five times after which the rider must cease their use of the whip for a minimum of five strides before striking the horse again with the drawn whip, with this restriction to apply prior to the final 100 metres. The whip may then be used at the rider’s discretion until the winning post is reached.

Prior to the final 600 metres of a race, official trial or jump-out the use of the drawn whip is acceptable if used in moderation and not continually.

Mr Goodwin showed all the relevant films and said that Mr MacNab had hit his horse 16 times before the 100m with only a brief respite of only 2 strides.

Mr MacNab said that he thought that he could catch up to those horses ahead and that he did hit his horse too much. He added that he stopped when he realised that he was not going to catch up.

Submissions for Penalty:

Mr Coles said that Mr MacNab had previously been issued with a warning only and submitted that a monetary penalty would be appropriate.

Mr MacNab said that he had a clean record and that he would prefer a suspension rather than a fine.

Reasons for Penalty:

Mr MacNab struck his mount 16 times with the drawn whip with very minimal respite offered. The Committee considered this to be towards the higher end of excessive whip use.

The Committee acceded to Mr MacNab’s preference for a suspension and determined that a 3 riding-day penalty was appropriate.
