As Mr Grylls admitted the breach we find the charge proved.
Penalty:
We grant Mr Grylls request to seek a deferment to his suspension as per Rule 1106(2).
Accordingly, we impose a suspension on Mr Grylls which will commence after racing on January 5 and conclude after racing on January 11 (4 North Island days).
Facts:
Following the running of Race 4, 2013/14 Dunstan Feeds Championship Final, an Information was filed pursuant to Rule 638(1) (d). The Informant, Mr Oatham, alleged that GRAPHIC (C Grylls) shifted inward near the 1800 metres when not clear of JAGERSFONTEIN which was checked and forced onto HER TO ETERNITY.
Mr Grylls acknowledged that he understood the nature of the charge, the Rule and confirmed his admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Neal identified on the films GRAPHIC who had drawn midfield (10) improved his position turning out of the straight and shifted inwards. As a result GRAPHIC checked JAGERSFONTEIN who was forced inwards onto HER TO ETERNITY which was tightened. Mr Neal advised that GRAPHIC was only a bare length clear of JAGERFONTEIN when it took her rightful running line.
Mr Grylls advised the Committee that the film was self-explanatory and he fully accepted that he caused interference to JAGERSFONTEIN.
Submissions for Penalty:
Mr Oatham produced Mr Grylls record which showed one previous breach under this Rule in the last 12 months. He said both the level of carelessness and resulting interference was low. He added that the Committee ought to consider the stake of the Race ($75,000). He submitted a suspension at the bottom end of the scale would be appropriate.
Mr Oatham advised the Committee that the rider declarations for Otaki on January 5 had closed.
Mr Grylls confirmed he had no riding engagements on January 5 and accepted any proposed suspension would not include that meeting.
Mr Grylls advised that he had commitments up to and including January 4. Mr Grylls asked the Committee to note that he was a busy rider and had a good riding record.
Mr Grylls confirmed that he had no intention to ride at Reefton on January 8.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Mr Grylls admission of the breach, the level of carelessness and resulting interference we assess as low and his very good record in relation to this Rule.
We note Mr Grylls was only a bare length clear when shifting inwards and this breach occurred in a race carrying a stake of $75,000.
After taking into account all the above factors we consider an appropriate penalty is a 4 day suspension.
