The charge is admitted, therefore pursuant to Rule 915(1)(d) the breach is deemed to be proved.

Miss Guy was fined $250.  

Facts:

Senior Stipendiary Steward, Mr Williamson filed an Information alleging Licensed Trainer, Miss D Guy failed to declare the rider of SCREAMIN EAGLE in race 6, the Karaka Million 3 YO Classic (Restricted Listed -$1,000,000).

Miss Guy noted on the Information that she admitted the breach and did not wish to be present at the hearing.

Rule 537 provides that:

The Trainer or Owner or lessee (as the case may be) or the Agent of the Trainer or Owner or lessee (as the case may be) for a horse accepted or deemed to have been accepted for a Race shall:

(a) declare to NZTR the name of the Rider of that horse by the time and date specified by NZTR for declaration of Riders for that Race.

Mr Williamson advised the Committee that prior to the commencement of the race meeting Miss Guy advised Stewards that Jockey, D Danis would be riding her horse SCREAMIN EAGLE in race 6. She said that a Rider was not notified earlier because she was of the understanding that she had engaged a Rider, but in fact that engagement had not been confirmed and as it transpired the Rider had already taken another mount in the race. 

Submissions for Penalty:

Mr Williamson said that the Declaration of Riders for the meeting closed at 1 pm on Wednesday 20 January 2021. He said that normally breaches of this nature incur a $50 fine and are dealt with by way of Minor Infringement Notice (MIN). However, on this occasion, Mr Williamson said that Stewards elected to file an Information due to the fact the breach occurred in a Restricted Listed race with stakemoney of $1,000,000. He said that given the status of the race the betting public are entitled to know well in advance of raceday who the declared riders are. He suggested that a fine in the vicinity $200 would be appropriate.

Although Miss Guy did not attend the hearing, we were told that when she was interviewed by Stewards she accepted that she had made a mistake and should have confirmed a rider prior to rider declarations closing.

Reasons for Penalty:

After consideration of the Stewards submission the Committee deemed that this matter can be dealt with by way of a fine. The Committee is of the view that the betting public is entitled to have all available information, including Riders well in advance of raceday. Particularly so given that Fixed Odds betting options were available.  Although this type of infringement would normally be dealt with by way of a $50 fine, given the status of the race a $200 uplift is deemed appropriate.
