The Committee ruled that RUM IN THE SUN was not denied a fair start.
Facts:
Following the running of Race 5, Darren DeFilippi Memorial (Junior Drivers) Handicap Trot, an information requesting a ruling was filed by Licensed Junior Driver, Mr J C Morrison, the driver of RUM IN THE SUN in the race, in relation to whether RUM IN THE SUN was denied a fair start.
Mr Morrison was present at the hearing of the information. Mr Morrison, a junior driver, was asked by the Committee whether he required the assistance of a senior horseman at the hearing but he indicated that he did not so require.
Rule 213 provides as follows:
(1) A Stipendiary Steward at any time may scratch from a race or declare ineligible to start in a race until a specific condition is met any horse on all or any of the following grounds:-
(j) if a horse was denied a fair start and such occurrence materially prejudiced the chances of that horse.
Submissions for Decision:
The Committee asked Mr Renault to show to the hearing a video replay of the start of the race, a 2600 metres standing start event for trotters. He pointed out RUM IN THE SUN, driven by Mr Morrison, having drawn barrier position 6 on the front row. The horse turned into line and, as the tape was released, the horse went away in a break and lost considerable ground, Mr Renault said.
Mr Morrison said that his was the last horse to turn in. He submitted that it was “quite tight” and that, just as the rest of the field was lined up and ready to go, he had to “manoeuvre” his sulky and was standing. Just as he was placing the reins under his seat and “getting ready to go”, the tape was released. He was not ready, causing his horse to break, he said. He had called to the starter just prior to the tape being released, he said. He was in an “awkward position” and side-on. He said that he had both reins in one hand when the tape was released.
Mr Renault commented that Mr Morrison was in his seat with his left foot in the footrest and the reins under his seat when the tape was released. The horse was lined up correctly and there was nothing to indicate that the horse had been denied a fair start. Stewards were not supporting Mr Morrison’s request that the horse be declared a late scratching. He submitted that the horse had simply broken at the start.
Reasons for Decision:
The Committee listened to the submissions of Mr Morrison in support of his request and to the submissions of Mr Renault and, also, carefully viewed the video evidence of the start of the race.
The Committee found that, just prior to the tape’s being released, RUM IN THE SUN was slightly out of position with Mr Morrison out of the sulky and attempting to straighten. However, at the moment that the tape was released, the horse was facing up to the tape in normal fashion and with room, Mr Morrison had the reins in hand and was sitting in his sulky. We could find no evidence that the horse went away in a gallop as a result of anything that had happened leading up to the start and, in those circumstances, the Committee was not prepared to find that it had been denied a fair start.
