In light of Mr Cameron’s admission of the charge and the clear video evidence of excessive use of the whip the breach was found proved.

Penalty:

Mr Cameron is suspended for 6 days for his clear excessive use of the whip on this occasion from today through until the conclusion of 11 May 2017. This suspension covers racing on the following dates: - 27 April 2017 New Zealand Metropolitan Trotting Club, 28 and 30 April 2017 Blenheim, 5 May 2017 New Zealand Metropolitan Trotting Club, 7 May 2017 Rangiora Harness Racing Club and 11 May 2017 Forbury Park Trotting Club.

Facts:

Following the running of Race 1, the Chris and Pauline Garrick Honorary Life Members Trot, an information was laid by Chief Stipendiary Steward Mr N Ydgren against Mr I Cameron, alleging a breach of Rule 869(2)(A), in that Mr Cameron used his whip in an excessive manner when driving Gin Rummy over the concluding 400 metres.

Rule 869(2)(A) reads:

“No horseman shall…use his whip in an unnecessary, excessive or improper manner”.

Mr Cameron admitted the charge in writing and did not attend the hearing being satisfied as to the charge itself.

Through video evidence Mr Quirk, on behalf of Mr Ydgren, showed Mr Cameron strike Gin Rummy with the whip 13, possibly 14, times during its run down the home straight to the finish with at least 3 or 4 strikes occurring in quick succession approximately 100 metres from the finish.

Submissions for Penalty:

Mr Quirk pointed to Mr Cameron’s record and in particular, as an aggravating factor, that Mr Cameron was suspended for 4 days on 9 April 2017 through until 20 April 2017 for excessive use of the whip on the same horse, at the same course. Today was Mr Cameron’s return to driving following completion of that suspension. Mr Quirk submitted that in light of that fact and the length of suspension imposed on the last occasion, a suspension of 5 or 6 days would be appropriate here taking into account the number of horses in work for Mr Cameron at present and his modest driving frequency (39 drives this season and 45 drives last season).

Reasons for Penalty:

After hearing the submissions of Mr Quirk and taking into account Mr Cameron’s admission it is determined that he be suspended for 6 days. Mr Cameron is suspended for 6 days because this was his second breach of this Rule within a fortnight in circumstances where he has returned from a suspension of 4 days length and immediately reoffended whilst driving the same horse at the same course. Mr Cameron needs to address this aspect of his driving or the suspension length will be significantly longer should he reoffend within a short time of his resumption of driving in May.
