Charge:
Following a trials meeting held at Te Teko on 2 August 2011, Miss A Edmeads was charged with having in her possession a body protector which did not comply with the NZTR rules of racing namely rule 610(4).
Facts:
Mr Oatham explained to the committee that at the trials meeting at Te Teko on 2 August he noticed Miss Edmeads wearing a body protector which had been modified.
Submissions:
Mr Oatham submitted this clearly contravened the standards set by NZTR regarding the wearing of protective vests.
Miss Edmeads, in admitting the breach, said she understood her obligations under this rule but said the vest had been supplied to her by somebody else. However she admitted knowing it did not comply.
Mr Bridgeman when asked had no submissions to make regarding the charge.
Submissions on Penalty:
Mr Oatham said all recent cases under this rule had incurred fines of $200. He added that although Miss Edmeads was a probationary rider and not licensed to ride race days it was important to maintain consistency with regard to penalties under this rule.
Mr Bridgeman submitted that Miss Edmeads had learnt her lesson from this mistake and said the rule was there for a very good reason that being one of safety to riders.
Miss Edmeads had nothing to submit regarding penalty.
Reasons for penalty:
The committee considered all the relevant facts and submissions as presented. Mitigating factors are Miss Edmeads’ admission of the breach and that this was her first charge. While the committee has some sympathy that Miss Edmeads is still a probationary rider and this offense occurred at a trial meeting the consequences to riders are the same at a race meeting or trial meeting. Clearly Miss Edmeads was aware of her obligations and understood the rule prior to wearing the vest in question.
Penalty:
Accordingly we impose a fine of $200.
