As Mr Waddell admitted the breach we find the charge proved.

Accordingly, we impose a $225 fine on Mr Waddell.
Charge:
Following race 8, an information was filed pursuant to Rule 330(3)(c). The informant, Mr Oatham, alleged that Mr Waddell failed to make the weight for REVOLUTIONARY.
Facts:
Mr Oatham informed the committee that Mr Waddell was unable to take the ride on REVOLUTIONARY because he was 1kg overweight. He advised that Mr Waddell had contacted the Stewards yesterday morning to inform them he would not be able to make the weight on IFFLEY ROAD at Paeroa. This resulted in a minor infringement in which Mr Waddell incurred a $200 fine.
Mr Waddell told the committee that he had wasted hard to ride MOSSE at 53kg prior to Christmas. He then recently became unwell and his weight had increased to 56kg. He acknowledged that he was struggling to get his weight back under control and he has told his manager not to accept rides under 56kg. He said with racing at Paeroa yesterday he was unable to shed any weight in a short period of time.
Submissions for Penalty:
Mr Oatham produced Mr Waddell's record which showed this was his 3rd charge in a short period of time. He submitted that were some mitigation as to why Mr Waddell could not make the carded weight. He said the Stewards had some sympathy for Mr Waddell and submitted an appropriate penalty would be a $200 fine.
Mr Waddell made no submissions on penalty.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions presented. The mitigating factors are Mr Waddell admission of the breach and he is recovering from being unwell. The aggravating fact this was his 3rd charge in a short period of time. We note that in his evidence Mr Waddell has handled the situation professionally by telling his manager not to commit to rides below 56kg. We are of the view that a small increase on yesterday's minor infringement penalty is warranted.
