Mr Tidmarsh, Stipendiary Steward, alleged that Mr Suddaby (FRANCO HUNTINGTON) used his whip in excess of the 10 permitted strikes in race 9, the Cruickshank Pryde Mobile Pace.
The Use of the Whip Regulations made pursuant to r 869(2) and effective 30 November 2017 provides:
No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.
Mr Suddaby has signed the information stating he admits the breach and does not wish to be present.
Mr Tidmarsh demonstrated on the videos that the respondent used his whip at least 12 times in the last 400 metres.

Mr Tidmarsh tells us Mr Suddaby has agreed that 12 is the number. We agree and note that this count includes a number of quick backhanders.
This is Mr Suddaby’s first breach of this rule since the regulations came into force on 30 November.
