As Ms Schwerin admitted the breach the Committee find the charge proved.

Penalty:

Accordingly, Ms Schwerin had her license to ride in races suspended for a period to commence after racing on 20 May and conclude after racing on 31 May 2017 (5 days).

That period of suspension encompasses meetings at

21 May – Rotorua

24 May – Pukekohe

27 May – Ellerslie

28 May – Hawera

31 May - Matamata

 

Facts:

Following the running of race 9, Adams Trimmer Insurance, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Ms Schwerin permitted her mount MAGIC OF THE SUN to shift inwards when not sufficiently clear of HONOUR PRINCESS which was forced inwards crowding SPIDER onto CREATIVE GENIUS which was checked near the 1000 metres.

Ms Schwerin acknowledged that she understood the Rule and confirmed her admission of the breach. Mr Harris assisted Ms Schwerin at the hearing.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Coles paused the head on film near the 1000 metres and showed that Ms Schwerin was racing in a 4 wide position. He said that Ms Schwerin allowed her mount to shift in when only a bare length clear of HONOUR PRINCESS. He said that Ms Schwerin dictated HONOUR PRINCESS in which resulted in SPIDER being crowded and checked. He said this eventually resulted in CREATIVE GENIUS running out of room and suffering a sharp check.

Ms Schwerin admitted that she should have allowed more room for the horses that were racing on her inside. She felt that Mr Saejorhor inexperience may have contributed to the incident.

Mr Harris said that Ms Schwerin had misjudged the shift inwards and agreed that the rider of HONOUR PRINCESS may have contributed to the incident.

Submissions for Penalty:

Mr Williamson produced Ms Schwerin’s record which showed 1 previous breach under this Rule in the last 12 months. He stated that 3 horses on Ms Schwerin’s inside were checked to varying degrees. He said that Ms Schwerin carelessness was in the mid-range and submitted a suspension in line with that.

Ms Schwerin advised that she had engagements at Te Rapa on 20 May any proposed suspension could start after that date. Ms Schwerin said that she rode at Taranaki last week and it was her intention to ride in the Central Districts on a more regular basis over the winter months.

Mr Harris said that he was pleased to see that Ms Schwerin was making an effort to ride outside her region. He asked the Committee to take into account Ms Schwerin good record and her admission of the breach.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Penalty Guide for Judicial Committees recommends that the starting point for careless riding is a 5 day suspension.

The mitigating factors were Ms Schwerin’s admission of the breach and her good record. This warranted a 1 day discount.

When reviewing the video footage the Committee observed that Ms Schwerin allowed her mount to shift in when only 1 length clear of HONOUR PRINCESS. This resulted in that runner being dictated inwards with SPIDER being crowded and forced into the rightful running line of CREATIVE GENIUS. This caused that runner to lose several lengths when the rider was forced to take a strong hold of her mount when badly checked. The Committee deemed the level of carelessness was in the mid-range for which a 1 day uplift was applied.

It was evident that Mr Saejorhor was entitled to be racing in a 3 wide position and the Committee was not satisfied that he contributed to the incident.

After taking into account all the above factors the Committee considered an appropriate suspension was 5 days.
