As Miss Direen had admitted this breach of the Rules it was found to be proved.
Penalty:
We therefore determined that Miss Direen's Apprentice Jockey's license be suspended from the conclusion of racing on Thursday 14 August 2014 until the conclusion of racing 29 August 2014 which encompasses the days racing at Timaru 22 August and Ashburton 29 August 2014 (2 effective days).
Facts:
Following the running of Race 6, the Glenmoa Farms Ltd/Oamaru Scaffolding Ltd R65 Benchmark Handicap, an Information was filed by Stipendiary Steward, Mr J McLaughlin, against Apprentice Jockey, Miss T Direen, the rider of NUTINEAR, alleging careless riding passing the 900m by shifting inward when not clear, causing checks to MISS PERFECTO, ridden by S Wynne, JACKSANFIVES, ridden by J Lowry and KASHIN GIRL, ridden by T Moseley.
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Miss Direen had indicated on the Information that this breach of the Rules was admitted and she confirmed this at the hearing. She also agreed that she understood the charge and the Rule it was brought under. As Miss Direen was an Apprentice Jockey, Miss K Williams, assisted her during the hearing.
Mr McLaughlin gave evidence and used video coverage, with the assistance of Stipendiary Steward Mr N Ydgren, to show that passing the 900m NUTINEAR, ridden by Miss Direen, was racing 4 wide with MISS PERFECTO, ridden by Miss Wynne, JACKSANFIVES, ridden by Mr Lowry and KASHIN GIRL, ridden by Mr Moseley, on her inner. Mr McLaughlin stated that Miss Direen attempted to take up the 3 wide position in front of MISS PERFECTO and in doing so was not clear of that horse, causing crowding to the inside runners. MISS PERFECTO, JACKSANFIVES and KASHIN GIRL were all checked to some degree with KASHIN GIRL receiving a severe check. Mr McLaughlin stated that Miss Direen was only 1 to 1 ¼ lengths ahead of MISS PERFECTO when attempting to cross in front of MISS PERFECTO.
Miss Direen and Miss Williams did not dispute the facts presented by the Stipendiary Stewards and made no further comment on the facts of the case.
Submissions for Penalty:
Mr McLaughlin stated that Miss Direen had two previous breaches of this rule in the past 12 months being Invercargill on 14 December 2013 where she received a 2 day suspension and 1 February 2014 at Otago where she received a 3 day suspension. He stated her record since then was clear. He said that Miss Direen had, in the Stewards' opinion, a good penalty record as she had not been before the JCA under this Rule for nearly 7 months. Mr McLaughlin submitted that the level of carelessness was low with the consequences high as KASHIN GIRL had received a severe check. After also taking into account her status as a South Island Apprentice Rider and her frank admittance of the breach, the Stewards would be seeking a suspension of 2-3 days. He also stated that consideration should be given to the fact that there is only 1 South Island race day per week at this stage of the season.
Miss Direen submitted that she was finishing her apprenticeship on 14 September and would like to ride at least 1 more race day as an Apprentice Jockey.
Deferment of penalty was not deemed an option for Miss Direen as the next meeting in the South Island district was on Friday 22 at Timaru, 8 days forward.
Reasons for Penalty:
In determining penalty the Committee took into consideration Mr Direen’s penalty record which we regarded as good. We also took into account her frank admission of the breach and her status as a South Island Apprentice Rider as well as the lack of opportunity for South Island riders at this time of the season with 1 race day per week. The Committee also took into account the level of carelessness which we assessed as low although the consequences of her actions were high. Taking the starting point as recommended by the JCA Penalty Guide of 5 days, we were able to give Miss Cuneen a discount of 1 day for her status as a South Island rider. We were also able to give Miss Direen a further discount of 2 days for her good record, her frank admittance of the breach, her status as an Apprentice Rider as well as the lack of opportunity at this time of the season for South Island riders. We therefore determined that a 2 day suspension was an appropriate penalty in this case.
