We impose a suspension from the end of racing today up to and including 1 November.
This we believe is equivalent to 5 days’ suspension, having regard to the fact that during this time a number of racedays are close together and PURE SUCCESS could not have started at all scheduled South Island meetings.
Facts:
Mr Renault, Stipendiary Steward, alleged that Ms Buchan drove carelessly in race 1 the CARPET PLUS WILLY’S FLOORING TROT, when allowing her horse, PURE SUCCESS, to contact the wheel of GRACE LIGHTNING causing her horse to break just short of the winning post.
Mr Renault demonstrated on the video that Ms Buchan in the run to the winning post had gone for a gap between EASY MOMENT and GRACE LIGHTNING. He said there had never been sufficient room for her to improve fully through the gap and as consequence PURE SUCCESS struck a wheel and broke. He said Ms Buchan was driving her horse forward with the whip at the relevant time and it had drifted down on the track and made contact with GRACE LIGHTNING.
Ms Buchan acknowledged she had gone for a gap, which had unfortunately closed on her. She agreed there had been contact with GRACE LIGHTNING and that PURE SUCCESS had galloped as a consequence. She stated she believed she was unlucky as in normal circumstances there would have been room for her progress fully through the gap. She said she was simply doing her best for the horse.

Mr Renault produced Ms Buchan’s record, which was clear for the past 2 seasons. He referred to the starting point, where there had been a relegation, of 3 days’ suspension in the Penalty Guide. He believed the breach was low end and that a penalty of encompassing 6 meetings was appropriate.
Ms Buchan emphasised that there had appeared to be a gap and, when questioned by this Committee, she stated this was the first time she had been charged with careless driving. She said she mainly drove her own horses and this was her 4th drive this season. She had only had about half a dozen drives last season. She asked that this Committee consider a short period of suspension.
Reasons for Penalty:
Ms Buchan’s degree of carelessness was not high, but her actions resulted in her horse breaking. She was endeavouring to progress into a dividend bearing position at the time and the only horse inconvenienced was her own.
The respondent has a clear record and has admitted the breach. It is difficult to determine the appropriate number of day’s suspension when Ms Buchan is only driving the one horse at present. We believe Mr Renault’s submission of 6 days is close to the mark.
