Facts:
This charge arises from the running of Race 6, the Stephen Marsh Racing Stables 1600. Senior Stipendiary Steward, Mr Williamson filed an Information pursuant to Rule 638(1)(d) alleging W Pinn allowed his mount, VIRTUOSO LAD, to shift in when not sufficiently clear of SAVASTEP which was hampered near the 1500 metres.
Apprentice Rider Mr Pinn acknowledged he understood the Rule and confirmed his admission of the breach. He was supported at the hearing by the Trainer of VIRTUOSO LAD (Mrs K Fursdon). Ms D Young (NZTR Welfare) also attended the penalty decision hearing in support of Mr Pinn.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Using the available race films Mrs L Selvakumaran demonstrated the incident and identified the two horses and Riders concerned in the incident: namely VIRTUOSO LAD (W Pinn) and SAVASTEP (S Collett). She pointed out that VIRTUOSO LAD and SAVASTEP jumped from barriers (6) and (5) respectively in the six-horse field. From its outside barrier, at the 1600 metre start, she identified that Mr Pinn permitted VIRTUOSO LAD to shift in near the 1500 metres when not sufficiently clear of SAVASTEP which was hampered and had to be restrained. At the time of the shift VIRTUOSO LAD was no more than ¾ to 1 length clear of SAVASTEP.
In response, Mr Pinn stated that he agreed with the Stewards' interpretation of the incident and had nothing further to add.
Submissions for Penalty:
Mr Williamson produced Mr Pinn’s riding record which indicated no previous breaches under the careless riding Rule since he resumed race riding 5 months ago (after a lengthy break). He said that prior to taking a break Mr Pinn had a poor riding record and to his credit since resuming he had had several race rides without a careless riding charge. On that basis, Mr Williamson described Mr Pinn as having a particularly good record.
Mr Williamson said Stewards assessed the level of carelessness to be in the low range.
Mr Pinn sought a deferment to any proposed penalty until after racing at Pukekohe on 24 March 2021. He offered no further submissions as to penalty. On his behalf Mrs Fursdon submitted that VIRTUOSO LAD is not an easy horse to ride and SAVASTEP was racing in an “ungainly manner” at the time.
Reasons for Penalty:
After considering the submissions and reviewing the race films, the Committee determined Mr Pinn’s carelessness to be in the low range and adopted a 4-day (suspension) and $250 (fine) as the starting point. This is in conformity with the revised NZTR Penalty Guide for low-range carelessness.
The available films clearly established that after jumping from the outside barrier Mr Pinn angled his mount across the face of the field intent on leading. In doing so he took the running line of SAVASTEP who was racing on his inner. The inward shift was not abrupt, however VIRTUOSO LAD was never its own length and one other clear of SAVASTEP.
Mr Pinn has had 254 rides and 26 winners since resuming race riding. He is a busy Apprentice Rider who is currently in high demand. His record over this period is therefore very good. On that basis, together with his admission of the breach we afforded him a 1-day reduction from the starting point.
After weighing up the factors we determined a 3-day suspension and $250 fine to be appropriate in the circumstances.
