Following the running of Race 4, an information was lodged by Mr Muirhead against the second placing of horse number 7 PERIGO (Driver P Ferguson), on the grounds of the lapped on Rule when it galloped over the concluding stages of the race.
Mr Ferguson represented the connections of the horse and endorsed the Information with the words “I do not contest the Protest”.
The official margin between 2nd and 3rd was half a length.

Mr Muirhead demonstrated the incident by use of the video films. The films quite clearly showed that PERIGO broke and galloped 2 strides prior to the finish line and was lapped on.
Reasons for Decision:
The protest is not contested and clearly the provisions of Rule 870 and the Breaking Horse Regulations apply.
