As Mr Turner admitted the breach we found the charge proved.

Mr Turner is suspended from the close of racing on Saturday April 15th up to and including racing on Saturday April 22nd. Days included are:

Facts:

Following the running of Race 3 (Gingernuts Cup), an Information was lodged by Mr M Davidson alleging a breach of Rule 638(1) (d) in that rider D Turner angled his mount THE HUNTSMAN out when not sufficiently clear of CLASS ABOVE passing the 300m.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Turner confirmed to the Committee that he understood the charge and he admitted the breach.

Mr Balcombe used the films to identify the runners involved. As the field entered the home straight Mr Turner went to the inside seeking a run but found no gap available. He then proceeded to angle outwards, when not the required distance clear of Mr Parkes (CLASS ABOVE), causing some interference to that runner.

Mr Turner agreed that he was not clear of Mr Parkes but said he was following the horse in front of him which also moved out. Mr Turner said he tried to correct his line of running and he used the video to show where his left arm was out in an attempt to do so.

Submissions for Penalty:

Mr Davidson said Mr Turner had only two previous careless riding charges over the previous 12 months but they had both occurred recently. He was suspended for five days at Hastings on January 1st and for four days at Taranaki on 18th February. Mr Davidson described this as a fair record. The Stewards placed the degree of carelessness in the low to midrange and submitted that a suspension in the vicinity of five days was appropriate.

Mr Turner, while admitting the breach, explained to the Committee that he had made an attempt to straighten his mount after angling outwards. He said he had commitments to ride at Taranaki on April 13th and at Riverton on April 15th.

Reasons for Penalty:

The Committee advised Mr Turner of the five day starting point for careless riding charges as outlined in the Penalty Guide for Judicial Committees. We were satisfied by the video evidence that Mr Turner did correct his line of running albeit after the interference occurred. We also heard evidence from Mr Davidson that Mr Parkes had reported to be only battling at the time and the incident did not affect his chances in the race. We therefore placed both the degree of carelessness and the consequences of Mr Turner’s actions to be at the low end. We viewed Mr Turner’s riding record as a neutral factor. Two breaches in 12 months might appear a very good record but the fact that they were both very recent indicates Mr Turner may need to reflect on the duty of care required in a race.

Taking into account Mr Turner’s ready admission of the breach and the low level of carelessness we found it appropriate to impose a four day suspension.
