As the breach is admitted it is found proved.

Penalty:

Mr Calder’s Licence is suspended for 4 riding days from the end of racing on 25 February 2021 until the end of racing on 5 March 2021.  Mr Calder is also fined $150.

Facts:

Following the running of Race 3, (The Spray Rig Sprint Maiden) the Informant, Stipendiary Steward Mr B Jones presented an Information alleging that Mr A Calder, the Rider of O’JESSICA, which finished first, breached Rule 638(1)(d) in that he rode carelessly at about 400 metres from the finish. It was alleged that he pushed his mount out when angling for a run, but not being sufficiently clear of DUBAI LADY ridden by Ms S Collett, causing it to be checked.

Mr Calder said that he understood the Rule and admitted the Breach.

The evidence of the Informant disclosed on the race films, was that at the 400 metres O’JESSICA racing behind and inside of DUBAI LADY, was angled out to obtain a run, but was insufficiently clear of that horse and contact occurred, which pushed it into the 3-wide line. A later action of another runner outside of DUBAI LADY shifted inwards to also cause interference to that horse.

Submissions for Penalty:

The Stewards submitted that the level of carelessness was low and Mr Calder has a reasonably good record with 2 careless riding breaches since 2020.

Mr Calder submitted that he accepted that, in riding “competitively”, he pushed into a gap he thought was there but accepted he breached the Rule in not being the required distance clear. He said he had riding engagements at Counties RC on 25 February 2021.

Reasons for Penalty:

The Guideline starting point (and it is no more than that) for low range careless riding is a 4-day suspension and a $250 fine. The good riding record justifies, in the Committee’s view, some mitigation from that starting point.

Suspension of 4 riding days after 25 February 2021 remains appropriate but the fine is fixed at $150.
