Charge:
It was alleged that M Edmonds ("Aces Fella") drove carelessly over the early stages when shifting inwards when not sufficiently clear of "Hotmamalinemypockets" (R May), "Tom Bola" (L O'Reilly) and "Getinbehind" (A Lethaby).
Facts:
Shortly after the start, Mr Edmonds, who at that time was racing in the middle of the field began a movement to cross over to the marker line. When doing so it was quickly apparent that Mr Edmonds did not carry out this movement when sufficiently clear of 3 other horses to his inside. The effect of Mr Edmond's action on the other three horses, who had to take evasive action, was seen on the video coverage of the incident. The horses in question had to run off the paths they had settled into, and it was fortuitous that none broke from their gaits.
By way of explanation, Mr Edmonds said that he had misjudged the situation, especially the presence of Ms Lethaby.
Submissions for Penalty:
Mr Ydgren told the hearing that Mr Edmonds was an experienced horseman but that on this occasion, he had made a misjudgement. The Stipendiary Stewards considered that the degree of carelessness was in the low to mid-range category, and as none of the affected horses broke from their gaits, their chances were not affected.
Mr Ydgren submitted that a fine of $200 should be imposed.
Reasons for Penalty:
The starting point for a fine for careless driving is $400 or 8 drives if a suspension is to be considered. We must then take into account the aggravating and mitigating features of the case.
The Stipendiary Stewards assess the degree of carelessness as being in the low to mid-range, because none of the three horses affected broke from their gaits and their chances were not affected.
It is this committee's view, that that may be the opinion of the Stipendiary Stewards, but we do not assess the degree of carelessness quite so lightly. The incident had real potential for disaster, and it was perhaps fortuitous there was not a significant incident as a result of Mr Edmond's actions. That is an aggravating feature and for that reason, an uplift of $50 on the starting point is imposed.
Against that we take into account Mr Edmond's excellent record and his early admission of the charge that enables us to afford a discount of $200 on the revised starting point.
