Facts:

Following the running of Race 10, the van de WATER JEWELLERS SPECIAL HDCP PACE an information was filed by Stipendiary Steward Mr C Allison alleging Mrs KL Barclay (Go The Stags) breached Rule 869 (2) (a) in that ..Mrs KL Barclay used her whip excessively over the concluding stages while driving out Go The Stags.

Mrs Barclay was present at the hearing and admitted the charge.

Mr Allison, with the use of the video replays, showed that Mrs Barclay used her whip on 21 to 22 occasions over the concluding stages. Apart from a short break with the use of the whip early in the run home, Mrs Barclay had used the whip continuously from that point.

Mrs Barclay stated Go The Stags was a lazy horse. She said there were no marks on the horse and was just doing the best for the owners.

Mr Allison stated Mrs Barclay had a previous charge of the same rule at Cromwell on the 7th January. On that occasion she had been fined $200. In this instance the use of the whip was at the lower end of the scale and was seeking a fine of $250.

Mrs Barclay stated she had admitted the charge at the outset and her whip use was at the lower end. She said her previous charge had arisen from driving on a grass track.

Reasons for Penalty:

Mrs Barclay was given credit for her early admission and also that the breach was at the lower end of the scale.
