Penalty:
Giving a discount for record, admission of the breach and clear remorse, the penalty is one day’s suspension. The suspension commences after racing tomorrow, June 5, and concludes on 8 June. This is one jumps day.
Facts:
Mr Williamson alleged that Mr Fannin used his whip excessively prior to the 200 metres in race 1 the WAIREPO HEREFORD STUD OTAGO STEEPLECHASE.
Mr McLaughlin, Stipendiary Steward, demonstrated on the videos that after the field had turned for home the respondent used his whip ten times before going back to the rein.
Mr Williamson said this was clearly in excess of the six provided for in the Whip Guidelines.
Mr Fannin stated the conditions were very testing, as the track was very heavy. He said he had become over-excited as a consequence of having a chance of winning. However, he was aware his mount was tiring, and was close to being out on its feet. He was just trying to get the best out of it. He said he had been very cautious not to repeat the breach in his next two rides, despite again being in contention.

Mr Williamson produced the respondent’s record. This evidenced a previous breach on 20 April when the penalty was a fine of $250.
Mr Williamson described this breach as lower end. He drew the Committee’s attention to the 3 day starting point in the JCA Penalty Guide. He believed a suspension was appropriate but emphasised the limited riding opportunities for jumps jockeys.
Mr Fannin emphasised that generally his record was very good, despite the fact he had a recent breach. He said he had had over 250 rides in New Zealand and only the one breach.

Mr Fannin has hit his horse 10 times before going back to the rein. We note the very testing nature of the track conditions, as emphasised by Mr Fannin. Mr Williamson stated this was a neutral factor but the breach could be fairly described as towards the lower end. The Committee agrees with Mr Williamson’s assessment of the gravity of the breach. There is thus no increase to the starting point.
In light of the fact jumps jockeys have limited riding opportunities, a starting point of 2 days is taken. The Committee asked Mr Williamson to confirm the number of rides the respondent has had. This was 243 before today. Mr Fannin’s record can thus fairly be described as very good despite the recent breach.
