Penalty:
Ms Johnson’s Jockey’s License was suspended from the close of racing on 2 January 2017 up to and including 14 January 2017 (6 days) and in addition a fine of $1,000 was imposed as an additional penalty given that she benefited by winning the race.
(January 3 at Thames was not included in the penalty as Ms Johnson advised the committee that she did not have any engagements on that day and the committee noted that the declaration of riders for that meeting closed on 29 December 2016).

Facts:
Following the running of Race 4 (Stella Artois Royal Stakes Group 11), Information No. A8658 was filed with the Judicial Committee. It was alleged by Mr Oatham that Ms Johnson, the rider of SHE BRINGS JOY allowed her mount to shift out when not sufficiently clear of ARCTIC MISS passing the 400m, which resulted in ARCTIC MISS being checked.
Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be (d) careless
Ms Johnson acknowledged to the committee that she understood the Rule and confirmed that she admitted the breach of the Rule.
Stipendiary Steward, Mr Williamson showed all film replays and identified the horses concerned. He said that near the 400m SHE BRINGS JOY who had been trailing the leader was looking to obtain clear racing room and that Ms Johnson forced her way out, making contact with ARCTIC MISS who was unbalanced and checked. He said that SHE BRINGS JOY was on level terms with ARCTIC MISS or at best, just behind (when shifting out).
Ms Johnson, for her part, said that she was travelling well behind them and that A Collett’s mount (ARCTIC MISS) was weakening and that it was a Group 2 race. She said that it had no effect on ARCTIC MISS who was just tightened or buffeted. Ms Johnson concluded by saying that rules are rules.
Submissions for Penalty:
Mr Oatham said that Ms Johnson had breached the rule only once in the past 12 months, that being at Trentham in The Oaks on 19 March 2016. The penalty that day being an 8 day suspension along with a $1,000 fine. He said that the aggravating factors on this occasion were that it was a Group 2 race worth $60,000 to the winner, that Ms Johnson had forced a run and put another rider in difficulty. He said that it was a reasonably deliberate move and was near the high end of carelessness. He invited the Judicial Committee to consider imposing a fine also given that Ms Johnson had benefited from her actions.
Ms Johnson said that she had a good record and that she did not have any real commitments following racing at Tauranga the next day, up until 14 January at Trentham. She added that she was not riding at Thames on 3 January 2017. Ms Johnson added that she would be travelling extensively to race meetings as at present she was at the top of the Jockeys' Premiership.
Reasons for Penalty:
The aggravating factors that the committee took into account were; that it was a Group 2 Race with a total stake of $100,000, the level of carelessness was deemed to be in the mid to high-range as the film evidence exhibited that Ms Johnson forced a run when there was insufficient room to do so, resulting in ARCTIC MISS having to be checked sharply after initially being tightened.
Ms Johnson’s mount SHE BRINGS JOY went on to win the race by a half-head.
The mitigating factors were that the breach was admitted, and that Ms Johnson had a very good record with only one breach during the past 12 months.
When considering quantum of penalty the committee had regard for the fact that Ms Johnson’s suspension will include two Premier race meetings.
The JCA starting point for careless riding is one of 5 riding days and having regard to the aggravating factors that was uplifted to one of 7 riding days. An allowance of one day was given for the admittance of the breach and record.
