As the breach was admitted we find the charge proved.

Penalty:

After taking all the above into account we impose a suspension on Mr Colgan from riding in races which is to start after racing on 7 January and conclude after racing on 18 January 2012 (5 days).  This deferral comes pursuant to rule 1106 (2).

Facts:

Following race 8 an information was filed pursuant to rule 638(1)(d).  The informant, Mr C George alleged that Mr Colgan permitted his mount DURHAM TOWN to shift inwards near the 900 metres when not sufficiently clear of MAE JINX (M Coleman) which was crowded losing its rightful running. 

Submissions for Decision:

Mr George said Mr Colgan had shifted in near the 900 metres when insufficiently clear of MAE JINX.  Mr George submitted that this check to MAE JINX resulted in her losing approximately 1 to 1 1/4 lengths.

Mr Colgan said he was disappointed with the charge because apart from this incident he believed it was a gem of a ride.

Submissions for Penalty:

Mr George produced Mr Colgan's record which was clear since July last year.  He submitted this breach was at the low end of the scale but reminded the committee this was a Group 1 race when assessing penalty.

Mr Colgan said he had commitments up to and including 7 January and upon questioning by the committee said he only rode throughout the North Island.

Reasons for Penalty:

The committee considered all submissions and evidence.  Mr Colgan's excellent record and his admission of the breach are in his favour.  The committee finds Mr Colgan's carelessness to be at the low end of the scale.  However the satus of the race being a Group 1 is a very relevant factor.
