Mr Cropp’s licence to ride will be suspended from the conclusion of racing on Wednesday 6 March 2013 until the conclusion of racing on Wednesday 13 March 2013. This is a total of four days. This incorporates the Otaki (8th), Auckland (9th), Egmont (11th) and Matamata (13th) meetings.
Charge:
Following Race 6, Apprentice Jockey M Cropp was charged with careless riding under Rule 638(1)(d). The information stated: ”M Cropp (POWELKA) allowed his mount to shift in soon after the start causing interference to KINDRED (D Turner).”
Rule 638(1)(d) states:

Mr Cropp indicated to the committee that he understood Rule 638 (1)(d), and that he admitted the breach. The committee was also advised that Mr Cropp was apprenticed to Mr R Manning, but as Mr Manning was not on course, he would be assisted by Mr Barnsley.
Using the head-on film, Stipendiary Steward Mr Whiterod identified Mr Cropp’s mount (POWELKA) and KINDRED (D Turner) soon after the 1400 metres start. POWELKA had drawn the outside gate, and started to come across soon after the start, moving into the line of Mr Turner’s mount, who was in some difficulty and had to be restrained away from the heels of Mr Cropp’s horse, which had taken its rightful line of running. Using the side-on film, Mr Whiterod identified that Mr Cropp was not sufficiently clear when moving across, and believed that Mr Cropp was not much more than 1 Length clear when he started to move across. Mr Goodwin stated he had questioned Mr Turner, who had estimated the margin to be in the vicinity of 1¼ Lengths.
Mr Cropp accepted he was 1¼ Lengths clear, but stated that the required distance was that of 1½ Lengths before such a movement could be undertaken, and that he had never known there to be a requirement for a horse to be 2 Lengths clear before shifting ground. He also believed Mr Turner had over-reacted, citing his own experience of being close to ‘clipping heels’ before, and never having had to react so severely in such circumstances.
Submissions for Penalty:
Mr Goodwin, in presenting Mr Cropp’s riding record, submitted that he was an apprentice with no charges since August 2012, as the records the stipendiary stewards had did not go back any further than that. He believed that Mr Cropp had a good riding record but that a term of suspension was warranted, submitting a four day penalty as appropriate. He also submitted that the stipendiary stewards considered Mr Cropp to be a North Island and a Central Districts rider.
Mr Cropp said he had nothing further to add. He indicated he had upcoming commitments up to and including Wednesday 6th March 2013 and would like any period of suspension to commence after those commitments.
Reasons for Penalty:
The committee had regard to all of the submissions put before it. The committee believed that a period of suspension was an appropriate penalty to impose on this occasion, and adopted a starting point of five days. The committee also accepted, based upon evidence, that Mr Cropp was a North Island rider. In mitigation, the committee considered Mr Cropp’s early admittance of the breach, his submission that Mr Turner had over-reacted and also that he was almost clear when he moved across. However, there were two aggravating factors that counter-balanced such mitigation. The first was that Mr Turner clearly suffered interference as a direct result of Mr Cropp’s carelessness, as evidenced by the head-on and side-on films. Of further concern to the committee was Mr Cropp’s lack of awareness of the requirement to be at least 2 Lengths clear before shifting ground. This is an obligation that he should be aware of, and as an apprentice who rides across the entire North Island, it is disturbing that he was unaware of this essential responsibility. On balance, a four (4) day period of suspension was considered to be an appropriate deterrent on this occasion.
