By way of explanation, Mr R McKay, Licensed Trainer, who was assisting Ms McKay, said that the horse spotted the rail and ducked inwards. He said that, effectively, the horse took itself in. He said that Ms C van de Werf on "Rio Rita" eased the pace of the field which made "Quantum Daf" panic. He asked the hearing to note that after the inwards movement, that Ms McKay then took evasive action.

Mr McKay said that Ms McKay has ridden a lot of slow horses and knows where she went wrong. He said that the horse was "green" and panicked when the pace was eased by Ms van de Werf. He submitted that a suspension would not help.He did not make any other suggestion as to penalty.
Mr T Hazlett, Apprentice's Mentor spoke favourably of Ms McKay and said that to date she had been riding horse that were well suited to her.
Reasons for Penalty:
The starting point for penalty for careless riding is a suspension of 5 riding days.Mr Davidson's submission is that the suspension should be for 2 weeks, which would equate to a suspension of 3 riding days. We note Ms McKay's good record to date and that Mr Hazlett as the Apprentice's Mentor speaks well of her. Ms McKay was riding a horse which was having its first raceday start. We accept that the horse may be described as "green". Ms Mckay's early admission of the charge and the other matters that we have referred to are mitigating features.
After taking into account the mitigating features we are able to come back on our starting point of a 5 day suspension and afford a discount of 2 days. We note that Ms McKay does not wish to apply for a deferrment of the coming into effect of the penalty.
