Facts:
Following the running of Race 3 (Splice Construction 1600) Information No. A11270 was filed with the Judicial Committee. It was alleged by the Informant that Mr McNeill had breached Rule 638(3)(b)(ii) in that he used his whip excessively when riding LADY AZAMOUR.
Mr McNeill confirmed that he admitted the breach and understood the Rule and the Whip Guidelines.
Stipendiary Steward Mr Jones showed the film replays and said that Mr McNeill used the whip 10 times prior to the 100m without giving the required respite.
Mr McNeill said that it was obvious what had happened but that he did not do it intentionally.
Submissions for Penalty:
Mr Coles said that Mr McNeill had a clean record and recommended that the JCA Penalty Guideline of a $300 fine would be considered as appropriate.
Mr McNeill did not make any comment regarding penalty.
