Accordingly, the protest is dismissed and the judge's placings shall stand.

In conclusion we order the payment of stakes and dividends.

Facts:

Following the running of Race 8 an information Instigating a Protest was filed pursuant to Rule 642. The informant Mrs Logan alleged that COSABELLA placed first by the judge interfered with the chances of MYGOODGRACE placed 2nd by the judge. The interference was alleged to occur inside the final 200 metres.

The judge's placings were as follows:

1st No. 9 COSABELLA
2nd No.4 MYGOODGRACE
3rd No. 3 SIRCROSS
4th No. 5 SARSARUN

The official margin between 1st and 2nd was a long head.

Submissions for Decision:

Mrs Logan told the committee that Ms Spratt advised her to lodge a protest because she could not ride her mount out over the final 100 metres due to COSABELLA hanging in badly. Mrs Logan believed the inward movement and the bump that MYGOODGRACE received from COSABELLA cost her horse winning the race.

Ms Spratt said over the final 100 metres she had to stop riding her mount and straighten it up due to the inward movement from COSABELLA. She said the margin of a long head was significant as her horse flew the last bit of the race.

Mrs Murdoch acknowledged that there was marked inward movement by her horse COSABELLA. She said there was slight contact, however believed that MYGOODGRACE had ample time to come again at the finish.

Mr Norvall acknowledged that COSABELLA does run in over the final 200 metres. He submitted he put his whip away to straighten his mount up and was on one rein to stop any interference. He submitted at no stage was there any contact between MYGOODGRACE and COSABELLA stating there was always daylight between the 2 horses. He concluded by saying that he did not use the whip in the final stages and his horse still run away at the finish.

Mrs Logan when giving the opportunity to sum up submitted the alleged interference occurred at the 50 metre mark which was a crucial time in the race. She further stated that Ms Spratt was unable to ride MYGOODGRACE out in the closing stages and believed the margin between the 2 horses at the finish was significant.

Mr Williamson was then asked for his assessment on the alleged incident. He submitted that there were a number of factors the committee had to consider. He pointed out that COSABELLA had come from behind MYGOODGRACE to win the race. He said there was no dispute that COSABELLA did shift in, however believed it was debateable contact was made between the 2 horses. He submitted that MYGOODGRACE shifted away from COSABELLA and couldn't be convinced that MYGOODGRACE would have beaten COSABELLA.

Reasons for Decision:

The committee carefully considered all evidence and submissions presented and reviewed the video films several times. The key reasons for our decision are as follows, we concede that COSABELLA does shift in significantly in the final straight when under pressure. The head on film showed that Mr Norvall did put his whip away and was on one rein to avoid any interference. The head on film was viewed frame by frame on several occasions and this showed that COSABELLA did not make any contact with MYGOODGRACE. Upon reviewing the film several times it was established that MYGOODGRACE does shift away from COSABELLA nearing the 50 metre mark making contact with SMOULDER with both horses becoming unbalanced.

The alleged interference between the 2 horses was not supported by the video film evidence.

For these reasons we are not satisfied that MYGOODGRACE would have beaten COSABELLA.
