As Ms Myers admitted the breach we found the charge proved.

Penalty:

Ms Myers advised that Mr K Myers was taking horses to Te Aroha next Sunday and it was probable that she would be riding for him. Following a broken leg last season she is seeking to ride more often and is looking for opportunities to do so right around the country. In order to impose a genuine penalty the Committee turned to Ms Myers recent riding history. Evidence submitted by the Stewards satisfied us that we could include all Waikato and Central Districts days in penalty.

Accordingly Ms Myers is suspended from the close of racing on Saturday August 27th up to and including racing on Wednesday September 7th.

Facts:

Following the running of Race 5, The Wanganui Racehorse Owners Association Maiden, an Information was lodged by Mr B Jones alleging a breach of Rule 638(1)(d) in that R Myers (AMORATA) shifted out near the 200m when not clear of TABARD (Z Moki) which was checked.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Ms Myers acknowledged she understood the nature of the charge and confirmed to the Committee that she admitted the breach.

Mr Goodwin played head-on, side-on and rear views of the incident which occurred in the home straight. As the field approached the 200m mark Ms Myers found herself blocked for a run in behind the leaders. She angled her mount out when not sufficiently clear resulting in rider Ms Moki having to check her mount. Mr Goodwin used the side on film to show that Ms Myers was only her own horse’s length clear of TABARD (Z Moki) when she moved out, not the required two lengths.

Ms Myers showed the head-on film from the top of the straight and pointed out where initially she angled for a run between Brendan Hutton and Timothy Johnson but, as a result of general movement, that run did not eventuate. She then moved out into the line of Ms Moki unaware that she was there. Ms Myers said there was no denying she caused interference to that runner but said it wasn’t intentional.

Submissions for Penalty:

In relation to penalty Mr Jones said Ms Myers had incurred only one suspension for careless riding over the last 12 months. This occurred on August 4th where she received a four day penalty. He submitted that this was a very good record for a senior rider and one who has as many rides as Ms Myers. Mr Jones said she admitted the breach at the earliest opportunity and the Stewards, on this occasion, placed the degree of carelessness and the consequences in the mid-range.

Ms Myers was invited to make submissions on penalty where she requested a deferment of any suspension to allow her to ride on Saturday at Hastings.

At the request of the Committee Mr Jones provided evidence of Ms Myers riding record over the last three months. This showed her taking rides at Marlborough, Waikato, Rotorua and Canterbury.

Reasons for Penalty:

In coming to a decision on penalty the committee took into account all of the submissions presented and adopted as a starting point of a five day suspension. It was our opinion that the degree of carelessness was in the mid-range. In seeking clear racing room Ms Myers angled her mount out on a relatively sharp angle when only one length clear of TABARD. Ms Moki was checked and her mount stumbled as a result of the interference it received. We applied an uplift of one day for the degree of carelessness.

Mitigating factors were Ms Myers ready admission of the breach and her riding record. She is a busy rider who has also been riding in Australia. We considered one suspension over a 12 month period to be an excellent record. Taking into account all of the relevant factors it was our opinion that a four day suspension was appropriate on this occasion.
