On account of the committee’s determination the protest second against first was dismissed, with the payment of dividends and prize money to be paid in accordance with the Judge’s placings.
Facts:
Following the running of Race 7 (Revital Fertilisers 1400), Information No.A3305 was filed with the Judicial Committee. The Information alleged that ZETOW caused interference to SKYCHI near the 150m.
The Judge’s placings were:
1st - No.8 Zetow
2nd - No.5 Skychi
3rd - No.1 Brave Cat
4th - No.9 Dal Vuitton
The margin between first and second was a long neck.
Rule 642(1) reads:
If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.
All present acknowledged that they understood the rule.

Mr Doyle said that prior to receiving the interference that his horse SKYCHI had shifted in a little. He then said that ZETOW shifted out and that his horse copped a check and that as a result it was put off balance for about four strides. He added that due to the heavy track conditions he thought that the interference made a difference to the outcome. Mr Doyle said that prior to the interference taking place SKYCHI had headed ZETOW, but said that he felt his horse was going to come back at ZETOW.
Mr Bothwell said that the head-on film clearly showed the interference, but that the side-on did not show it as clearly. He added that his horse (SKYCHI) was impeded.
Mr Leung said that his horse ZETOW shied at tyre marks on the track and that he did not use the whip as he was trying to keep it straight. He added that when he did use the whip it went away from the other horse (SKYCHI). He said that from around the bend up until the 200m SKYCHI was in front of his horse by about a neck.
Mr Caskey the trainer of ZETOW said that the horses did not actually make contact; he said that although his horse came across SKYCHI that they did not touch. He added that at no stage did the rider of SKYCHI have to stop riding or straighten his horse and over the final stages it was clear that his horse was going away from SKYCHI. He added that this was very obvious on the films.
Mr Whiterod said that in his opinion contact was made near the 150m and at that stage ZETOW held a slight advantage. He said that the protest had merit.
Reasons for Decision:
The committee found that early in the run home SKYCHI had headed ZETOW and that near the 200m ZETOW had regained the lead. Soon after, ZETOW shifted outwards abruptly and made contact with SKYCHI and forced that horse off its rightful line of running. Following the interference the committee observed that ZETOW finished strongly to win the race by a long neck.
Taking into account the run of both horses over the final 300m of the race, the committee was not satisfied that if interference had not occurred that SKYCHI would have beaten ZETOW. The primary reason being that SKYCHI had been racing in front of ZETOW for some distance and only received interference after being headed.
