Mr Wiseman having admitted the breach; the charge was found proved.

Accordingly, Mr Wiseman is fined $250. 

Facts:

Following the running of Race 8 an information was filed by Chief Stipendiary Steward, Mr N Ydgren, against a driver from the USA Mr S Wiseman, alleging that “S Wiseman (AVEROSS RUSTLER) drove carelessly near the 1100 metres when allowing his horse to strike the sulky wheel of DOCTOR TIM.”

Mr Wiseman confirmed that he understood the rule he was being charged with and indicated that he admitted the breach.

Rule 869 provides as follows:

(2) No horseman in any race shall drive: -

(b) carelessly

Mr Ydgren used the race films to identify Mr Wiseman racing towards the rear of the field approaching the 1100 metre mark. Mr Ydgren pointed to Mr Wiseman angling out to a 3 -wide position and strike the wheel of DOCTOR TIM, two times, deflating its tyre. He said the incident was a lack of judgement.

Mr Wiseman was forthright with his admission and added he hadn’t hit a wheel for years. 

Submissions for Penalty:

Mr Ydgren stated the starting point for a breach of this nature and commended Mr Wiseman on his professionalism in the Stewards' room.

Mr Wiseman had nothing to add.

Reasons for Penalty:

In determining penalty, the Committee considered this to be a mid-range breach and have adopted the JCA Penalty Guide starting point of a $300 fine for any time a driver hits a wheel with consequences. There are no aggravating factors to consider.

The mitigating factor is his frank admission of the breach.

The Committee in considering all the above factors find that a $250 fine is appropriate in this case.
