Ms Olney admitted the charge and it is found proved.

Penalty:

Ms Olney is suspended for four and a half weeks, from the conclusion of racing on 29 September 2017 up to and including 1 November 2017. This is 6 South Island days.

Facts:

Mr Davidson filed an information alleging Ms Olney (BELLE BOY) rode incompetently in Race 2, the AON Insurance Brokers Handicap.

Rule 638 reads:
(1) A rider shall not ride a horse in a manner which the Judicial Committee considers to be
(e) incompetent

Ms Olney attended the hearing and was assisted throughout by her employer and BELLE BOY’s trainer Mr K Tyler. Ms Olney admitted the breach.

Mr McLaughlin, with the assistance of the video replays, outlined the Stewards’ concerns regarding Ms Olney’s ride. He said that Ms Olney had drawn barrier 3 and on release she had been slightly tightened and always going to be back. He pointed to Ms Olney taking a hold of the reins. She took another hold and it was 11 strides before she gave the horse a slap to get going. Ms Olney was some 20 lengths behind the last runner, after the horses had only travelled approximately 200 metres.

He further identified that Ms Olney (BELLE BOY) had done some work and caught the other 5 runners near the 800 metres. At the 600 metres, Ms Olney had encouraged her horse to get going and was 4 to 5 wide, not on the rail. He further stated that as the horses entered the straight, Ms Olney was 7 wide in a 6 horse field.

Mr Davidson stated that Ms Olney had no chance at all after making up the lost ground.

Ms Olney stated that when they jumped she should have had a stronger hold on the horse and after the tightening it was an over-reaction. When she did bring the horse back, it was over racing as this horse favoured its off side foreleg, which made it difficult to get near the rail.

She further stated that she could have given the horse more rein, but did not feel the need to hunt him up until the 800 metres. At the 800 metres the horse was still favouring its off foreleg, which again made it hard to stay near the rail.

When questioned by the Committee, she admitted she made wrong decisions, restraining the horse after the start and then at the 800 when she picked the field up. She should have stayed on the rails and covered no extra ground. She stated the horse started getting into its work at the 800 metres and the horse had won before by coming around the field.

Mr Tyler said it was pretty clear Ms Olney had the horse on a tight rein at the start but the damage had been done in the first 100 metres. He noted that the horse has “been round a few times, settles back and also likes it a bit wetter than today”. He further stated the horse “likes to get out and get around them”.

Submissions for Penalty:

Mr Davidson stated that Ms Olney does not appear on any record and this was her first ride back. She rode at the Winton trials last week and after some consideration she was given her raceday licence.

He further stated that the rights of the punter need to be protected, with BELLE BOY being well supported today but its chances were blown at the start.
Mr Davidson added that the JCA penalty Guide has a starting point of 6 weeks, this was Ms Olney’s first day back riding after a 2 year absence and the breach was admitted at the first opportunity. He further stated that a recent similar charge against Mr Bohorun in June resulted in a 4 week penalty. He recommended during her suspension that Ms Olney get assistance from senior riders and also spend time with the Appprentice Riding Mentor, Mr Walsh.

Ms Olney stated that she had had 30 race day rides with 3 winning rides previously and had never been charged. She stated she would ride at trials and would get better with the help of senior riders and Mr Tyler.

Mr Tyler said that trials are not that frequent, every 2 weeks or so and only 18 to 20 horses are at the trials.

A discussion was held around possible trIal dates that are pending in the Southern region. Mr Davidson then added that with Mr Walsh involved, there may be a possibilty of Ms Olney riding at the trials in the Canterbury region to get more experience.

Ms Olney stated that she would only be riding Mr Tyler’s horses until she was ready.

Mr Davidson said that a 2 month suspension was not ideal as Ms Olney needs more experience. The penalty should be weeks not meetings. He further added that we need to encourage younger riders.

Mr Tyler confirmed that his horses would be at all South Island meetings. He confirmed that Ms Olney would have horses to ride for him, but not at Riccarton until she had more experience. She had to build her confidence up and take small steps.

Reasons for Penalty:

Ms Olney has made a number of misjudgements in her ride on BELE BOYR. Her initial hold on the reins after being tightened at the start and then again her subsequent taking hold of the reins and not allowing her mount to stride out for a number of strides, thus ending up some 20 lengths behind the field after only 200 metres. Then again at the 600 metres where she encouraged her mount to go forward albeit 4 to 5 horses wide, and then when entering the home straight her mount is 7 wide and then quickly faded. It was apparent that her horse’s chances were all but extinguished by her actions.

We adopt the JCA Penalty Guide starting point of 6 weeks.

In mitigation we take into account the respondent’s very limited experience, her early guilty plea, her remorse and her ready acceptance of the fact that she had made some misjudgements.

The Committee agreed that Ms Olney needed to gain more experience with trial rides, more track work, the guidance of senior riders and to work closely with Mr Walsh, the Apprentice Jockey Mentor.
