The protest is not contested and is therefore upheld. PRINCE FEARLESS is accordingly disqualified from the race.

The amended placings are :

First - (11) MONBET

Second - (3) SPEEDING SPUR

Third - (1) ONE OVER DA MOON.

Fourth - (4) STENT

Fifth - (13) ALLEY WAY.

It is ordered that stakes be paid in accordance with the amended placings.

Facts:

Following the running of the 2015 JEN CAMPIN BLOODSTOCK NATIONAL MOBILE TROT an Information instigating a protest was lodged by Stipendiary Steward, Mr JM Muirhead against the 5th placing of PRINCE FEARLESS on the grounds of breaking in the early stages of the race and continuing in a break in excess of 150 metres.

Rule 870(3) provides that any horse that breaks from its gait during a race shall promptly regain its gait. The Breaking Horse Regulations provide that any horse which breaks from its gait and continues in a break for more than 150 metres shall be in breach of Rule 870(3).

Mr M Purdon the Co Trainer of PRINCE FEARLESS was not present at the hearing but endorsed the Information with the words " I do not contest the Protest "

Co-Chief Stipendiary Steward, Mr N McIntyre demonstrated the incident by use of the race films and showed PRINCE FEARLESS breaking in the early stages of the race and continuing in a break for over 200 metres.

Submissions for Decision:

Mr Muirhead submitted that because PRINCE FEARLESS had galloped for more than 150 metres it was therefore in breach of Rule 870(3) and should be disqualified from the race.
