Facts:

Following the running of Race 10, “Glenferrie Farm” Four & Five Year Old Trotters Championship (Group 3), Information No. A6125 was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Open Horseman, Mr M Purdon, alleging a breach of Rule 868 (3) in that Mr Purdon, as the driver of CYCLONE U BOLT in the race, “failed to drive CYCLONE U BOLT out over the final 150 metres when [he] had a reasonable chance of finishing in 5th place”.

Mr Purdon was present at the hearing of the information and he indicated that he admitted the breach of the Rule.

Rule 868 provides as follows:

(3) Every horseman shall drive his horse out to the end of the race if he has any reasonable chance of running first, second, third, fourth, fifth, or sixth

Mr Ydgren had Mr M Zarb, Stipendiary Steward, show video replays from a number of angles of the final 200 metres of the race. He pointed out Mr Purdon, driving CYCLONE U BOLT, racing in 6th position behind LOTALOV (D J Butt). Mr Ydgren said that Mr Purdon could be seen, in the early stages of the run home, to drive his horse with the whip and reins. However, from about the 150 metres, there was no discernible action from Mr Purdon to place his horse under any pressure.

Mr Purdon said CYCLONE U BOLT was a tired horse. He submitted that the video replays showed that Mr Butt, who had finished 5th, had not been “vigorous” in driving his horse. He said that, on turning in, he gave his horse a few with the whip but the leaders were going ahead of him. His and Mr Butt’s were two tired horses at the end of the race, Mr Purdon said.

Mr Ydgren pointed out that there were stakes payable back to 5th place in the race. The Committee noted that there was a 5th stake of $533. Mr Ydgren submitted that the videos spoke for themselves.

The Committee observed that CYCLONE U BOLT had gradually made ground on LOTALOV in the final 150 metres and, at the finishing line, was approximately a head from 5th placing.

Submissions for Penalty:

Mr Ydgren said that Mr Purdon has a clear record under the Rule. He pointed out to the Committee that the Penalty Guide provided for a starting point of 12 drives or a $600 fine “with particular regard being had to the placing involved”. In this case, we were concerned with the “lowest possible placing”, Mr Ydgren submitted. He told the Committee that driver, D, had been fined the sum of $300 recently in a Group 2 race where 5th and 6th placings were involved, as in the present case.

Mr Purdon repeated that CYCLONE U BOLT and LOTALOV were two tired horses and the gap between them and the first four horses was increasing. He felt that he had hit the horse enough early in the run home and that the horse was not giving him any more. Although he had closed the gap on Mr Butt, he had closed the gap with a tired horse, Mr Purdon said.

Reasons for Penalty:

The Committee considered that the starting point provided in the Penalty Guide of 12 drives or a $600 fine was appropriate in only the very worst case. The present case was not the worst. It involved 5th placing for which there was a stake payable of $533. Mr Purdon was very frank in his admission of the breach and he submitted that his horse was very tired. The Committee accepted that this was the case and we have taken this into account.

Taking these factors into account, together with Mr Purdon’s record, the Committee determined that an appropriate penalty was a fine of $300. In arriving at this fine, the Committee also looked at its database of penalties for breaches of the Rule.
