Decision:

The Committee was satisfied that the gate of MADANSKE had failed to open on terms with the rest of the field through a mechanical failure. Further, the Committee was satisfied that MADANSKE was thereby prevented from taking an effective part in the race – it had to force its way out of the barrier and, clearly, lost several lengths as a result – notwithstanding that it did finish in 4th placing in the race. The horse was not slow away of its own accord.

Facts:

Following the running of Race 9, Birchfield Coal Mines Rating 70, an information requesting a ruling was filed by Stipendiary Steward, Mr R L Neal, pursuant to Rule 632, as to whether “the gate failed to open and MADANSKE was denied a fair start”.

Miss R A Frost, trainer of MADANSKE, was present at the hearing of the information.

Rule 632 provides as follows:
If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.

MADANSKE finished in 4th placing in the race.

Submissions for Decision:

Mr Neal showed a head-on video replay of the start of the race. He pointed out MADANSKE (N J Gow), drawn the outside barrier in the nine-horse field at the 1400 metres start. He submitted that it was quite clear from the video replay that MADANSKE’s gate did fail to open and that the horse had to push the gate to open it.

Mr Neal then showed a side-on video replay and submitted that MADANSKE had lost “significant ground” as a result of its gate failing to open. Its chances of recovering on a track like Reefton had been “severely compromised”. The video replay showed that the horse had lost several lengths and was in last placing when the field left the barriers.

He submitted that MADANSKE should be declared a non-starter.

Miss Frost stated that she agreed that the horse should be declared a non-starter.

Reasons for Decision:

The Committee ruled that MADANSKE be declared a non-starter.

As a consequence, the amended result for the race is as follows:
1st 9 Bumpy Halo
2nd 3 Hill of Gold
3rd 7 Heaven Sent
4th 1 Cape Fear
5th 8 Overdraft

It was ordered that dividends and stakes be paid in accordance with that amended result.
