Accordingly after considering all the above facts and under the provisions of rule 1106 (2) (a) we suspend Mr Dell from riding in races which is to start after racing on 3 October and conclude after racing on 11th Ocober 2012 (6 days).

Facts:
Following race 2 an information was filed pursuant to rule 638 (1) (d). Mr Oatham alleged that Mr Dell permitted his mount DEMOPHON to shift outwards passing the 150 metres when not sufficiently clear crowding GINJA NINJA on to HAPPYTO KEEPA which were both checked.
Submissions for Decision:
Mr Oatham demonstrated the video films which showed DEMOPHON ridden by Mr Dell racing on the rail approaching the 150 metres. At this stage Mr Dell was riding hard with the whip and allowing his mount to move out 2 horse widths. Mr Oatham submitted that Mr Dell was not clear of GINJA NINJA when moving out but conceded that TIME LEGEND had contributed to the interference by also moving out slightly. He said the result of this outward movement was HAPPYTO KEEPA having to be checked.
Mr Tiley on behalf of Mr Dell conceded that Mr Dell had moved out 2 horse widths but Mr Shirahama hadn't helped by also moving out slightly. He said it was an error of judgement on Mr Dell's part and he would have a talk to him.

Mr Oatham said this was Mr Dell's 6th charge in the last 12 months which was of some concern. He submitted today's breach was in the mid range.
Mr Dell said he had commitments until 3 October and he rode throughout the North Island.
Reasons for Penalty:
The committee has carefully considered all evidence and submissions as presented. Mitigating factors are Mr Dell's admission of the breach and the contribution to the interference by Mr Shirahama. However these factors must be considered alongside the aggravating factors the most important of which is the interference suffered by GINJA NINJA and HAPPYTO KEEPA through Mr Dell moving out when not clear. The committee has also taken into account Mr Dell's record and explained to him their concern that this was his 7th charge in 12 months.
