Facts:
Following Race 4, The Ekraar @ Linwood Park Stud Handicap, a protest was lodged pursuant to Rule 642(1) by Mr R Neal alleging that horse number 9 (SHE’S SLINKY) or its rider placed 1st by the Judge interfered with the chances of horses number 5 (KUZANOV) and 7 (FLINT)placed 4th and 2nd by the JUDGE.
The information alleged interference in the final straight.
Judge's placings were:
1st SHE’S SLINKY (9)

3rd GOSSIPING (3)
4th KUZANOV (5)
5th BARBERRY ROZE (8)
The official margins were a nose between 1st and 2nd, a long head between 2nd and 3rd and a head between third and fourth.
Submissions for Decision:
Mr Neal lodged the protest and began by asking Mr Goodwin to explain the incident using the films. The head on view showed Mr Walsh in the lead racing adjacent to the outside running rail. Near the 200 metres his horse SHE’S SLINKY appeared to shy and shifted in abruptly into the line of KUZANOV, ridden by Mr Parkes, who was forced inwards across the line of FLINT (A Taylor). Mr Neal described the interference as severe with the chances of both horses being badly affected.
Mr Parkes told the committee he was finishing well and was going to win the race. He said KUZANOV was a big awkward horse and it was hard to regain the loss of momentum. Mr Thurlow said his horse was going up to win and its chances were severely affected when SHE’S SLINKY shied inwards.
Ms Taylor (FLINT) said her horse was racing competitively prior to the incident and she thought she was going to win the race. She said the interference stopped her badly but at the finish she was running on strongly. Mr Renall said FLINT was a big long-striding horse who was put off balance and shifted many horse-widths inwards. In his opinion he would have won by half a length at least if he hadn’t been interfered with.
Mr Walsh asked for the back film to be shown to highlight the relative positions of the horses prior to the interference taking place. This showed SHE’S SLINKY well in front of KUZANOV and while Mr Walsh said there was no doubt that interference occurred his horse was also affected. He said SHE’S SLINKY pulled up to a canter, the other two horses headed his mount, but he then came again to win the race.
Mr Lambert said SHE’S SLINKY moved inwards only briefly and he believed that KUZANOV had overreacted to that movement.
Reasons for Decision:
In coming to a decision the committee carefully considered all of the evidence presented. There was no doubt that interference occurred as a result of SHE’S SLINKY running abruptly inwards approximately three horse widths. KUZANOV was forced off its rightful line of running by at least six horse widths and in turn forced FLINT inwards over a similar distance. The interference occurred at a critical stage of the race with all the riders mounting strong challenges for the finish. The interference suffered by both KUZANOV and FLINT was severe with both horses being moved inwards over many horse-widths and yet both managed to rally and finish strongly at the finish. Taking into account all of these factors including the narrow margins between the first four runners at the finish we were satisfied that the protest should be upheld.
