As Mr Turner admitted the breach, it was deemed to be proved.

Penalty:

Accordingly, Mr Turner’s license is suspended from the close of racing today November 2nd 2019 up to and including racing on Tuesday, November 12th 2019.

Facts:

Following the running of Race 5 (PGG Wrightson 1400), an Information was lodged by Mr Goodwin alleging a breach of Rule 638 (1) (d) in that D Turner allowed his mount ONE PRIZE ONE GOAL to shift in when not clear of HARLEM “N” CO which was checked near the 1200m.

Mr Turner confirmed his understanding of the charge and his admission of the breach.

Mr Balcombe used the videos to show where Mr Turner jumped from a mid-field barrier, had a look to his inside and then crossed in front of Mr Waddell’s mount when not clear. Mr Goodwin said the Stewards had questioned Mr Waddell following the race and while he agreed that Mr Turner had cut in front of him he said his horse was travelling hard and had contributed to the interference.

Mr Turner said he thought at the time he was clear of Mr Waddell but accepted he had cut the margin a bit short. Mr Turner explained that between the time he looked and moved across the margin had narrowed due to Mr Waddell’s horse over-racing.

Submissions for Penalty:

Mr Goodwin produced Mr Turner’s careless riding record, which showed careless riding charges in March 2019 (5 days), December 2018 (5 days) and November 2018 (5 days). Mr Goodwin said these were all low-level breaches, as was today’s incident, and Mr Turner did not often bother the Stewards by riding carelessly.

Mr Turner described himself as a “travelling jockey” riding 3-4 days each week and asked the Committee to take into account his good record.

Reasons for Penalty:

The Committee considered all submissions. We accept that this was a low-level careless riding breach. Mr Turner was aware of Mr Wadddell to his inside and was almost clear of that runner when he crossed, being only ¼ length in arrears. Mr Waddell’s mount was throwing its head around and proving difficult to settle, which made the interference worse than it otherwise would have been.

We have ignored the November 2018 careless riding breach as it was almost 1 year ago and considered 2 previous indiscretions under the rule to be a good record for Mr Turner.

Balancing up all factors including his admission of the breach we are imposing a 5-day suspension.
