Accordingly, the Committee declared both Hermione and Giovanna Bella to be non – starters.

Facts:

Following race 5, Broadway Motel 1400, an information was filed pursuant to Rule 632. The Informant, Mr Coles, Request a Ruling if Hermione and Giovanna Bella were denied a fair start due to gates being slow to open.

Rule 632 states: “If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.”

Submissions for Decision:

Mr Williamson demonstrated on the head on film that the 2 gates concerned both appeared to be fully shut when all the other gates had opened.

Mr Innes submitted that he advised Mr Sargent the trainer of Hermione that her gate was slow to open but could not say whether it affected her chances.

Mr Bosson submitted his mount was a bit fractious prior to the start and her gate was clearly slow to open and it affected her chances.

Mr Coles submitted the video films clearly show that both horses were denied a fair start due to a mechanical failure of the starting stalls. He said the head on film showed that both horses jumped away awkwardly and that could be to do with the slow gates. He further submitted the 2 horses then came together.

Mr Moody submitted that Giovanna Bella was fractious prior to the start and had a barrier attendant up holding its head. He admitted the barriers were slow to open probably because Giovanna Bella was rocking and rolling in the stalls which he believed can put pressure on the gate pins. He submitted this can affect the starting stalls opening in unison.

Reasons for Decision:

The Committee carefully considered the submissions presented and reviewed the video films several times. The head on film clearly shows that Hermione and Giovanna Bella gates were slow to open. This had an impact with both runners jumping out awkwardly and making solid contact with each another.

The Committee reviewed the film and determined that Giovanna Bella was settled and not fractious as the gates opened. This established that Giovanna Bella was not slow away by its own accord.

In my view both horses were prevented from taking an effective part in this race because of the mechanical failure of starting stalls. Therefore I am satisfied that both horses should be declared non-starters.
