As Mr Goindasamy admitted the breach the Committee found the charge proved.

Penalty:

The Committee granted a deferment to Mr Goindasamy’s suspension pursuant to Rule 1106(2).

Accordingly, Mr Goindasamy had his license to ride in races suspended for a period to commence after racing on 22 September and conclude after racing on 4 October 2019.

The race meeting scheduled for Te Aroha on 29 September was not included in the penalty because the day is programmed for Jump / Highweight and Amateur riders only.

Facts:

Following the running of race 2, RBC Racing 1600, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Jones, alleged that Mr Goindasamy permitted his mount TAREE to shift out passing the 200 metres when insufficiently clear of GRAND ARIANA which was checked.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Goindasamy said that he understood the Rule and confirmed he admitted the breach.

Mr Harris assisted Mr Goindasamy at the hearing.

Mr Williamson demonstrated the incident using the available video footage. He identified that near the 250 metres TAREE was held up for a run. He said shortly after that point Mr Goindasamy angled his mount outwards off the heels of LILY THE PINK when insufficiently clear of GRAND ARIANA. As a consequence that runner was checked. In conclusion he described the incident as an error of judgement on Mr Goindasamy’s part.

Mr Goindasamy said that he thought he was clear when he angled his mount outwards. He accepted that he rode in a careless manner.

Mr Harris stated Mr Goindasamy was a bit unfortunate in that he caused Mr McNab to take a hold of GRAND ARIANA. He added that Mr Goindasamy needs to learn to “slow it down” when shifting ground.

Mr Jones produced Mr Goindasamy’s record which showed 6 previous breaches of this Rule in the last 12 months.

Mr Jones said to Mr Goindasamy’s credit he admitted the breach and described the level of carelessness as low range. He said Mr Goindasamy’s had 6 previous breaches in the last 12 months which meant his record was not good. However, he noted that there were only 3 breaches in the last 9 months. He added that Mr Goindasamy was trying to make an improvement to his careless riding record.

Mr Goindasamy was unsure of his upcoming engagements. Therefore the Committee granted an adjournment to the hearing so Mr Goindasamy could contact his employer Mr Manning.

Mr Goindasamy said that he had engagements at Counties on 22 September and any proposed suspension could start after that date.

Mr Harris said that Mr Goindasamy’s record had improved immensely in the last 9 months.

Reasons for Penalty:

The Committee considered all the evidence and submissions presented.

When reviewing the video films the Committee found that Mr Goindasamy looked to his outside passing the 250 metres when he angled TAREE outwards in an abrupt manner. In doing so he was only 1 ¼ lengths clear of GRAND ARIANA which was checked. The Committee deemed the level of carelessness displayed by Mr Goindasamy was low range.

The JCA Penalty Guide starting point for low range carelessness is 6 national riding days which was adopted.

Mr Goindasamy’s record was deemed to be poor with today being his 7th breach in the last 12 months. This aggravating factor warranted a 2 day uplift in penalty.

The mitigating factor was Mr Goindasamy’s admission of the breach. For this he was afforded a 1 day reduction in penalty.

After taking into account all the above factors the Committee considered that an appropriate suspension was 7 national riding days.
