Mr Johnson has admitted the charge and it is found proved.

Penalty:

Mr Johnson is suspended from the end of racing on 4 January 2021 up to and including 14 January 2021. This is 4 days, and he is fined the sum of $500.

Facts:

Following the running of Race 9 the Stewards charged Mr Johnson with a breach of r 638(1)(d) in that he permitted his mount ROC MUSIC to shift inwards shortly after the start when not sufficiently clear crowding GLORIOUS MISSILE and BENTLEY which were checked.

Mr Oatham demonstrated on the videos that Mr Johnson had drawn 2 from the outside and shortly after the start he shifted inwards abruptly across the field. In so doing, he came into the running line of Ms Jonker, who had to check, as did Ms Comignaghi. The side-on video evidenced Mr Johnson was only a length ahead of Ms Jonker when he shifted.

Mr Johnson said he had come out of the gates “quick” and thought he was further forward than he was. He had not realised he had checked any runners until he viewed the video. He said no one had yelled out to him.

Mr Davidson said Mr Johnson had three previous breaches of the careless riding Rule. One was almost a year ago and two were in a short time in November. He described the breach as mid-range. Two horses had lost their rightful line of running.

Mr Johnson, after consideration, accepted it was a mid-range breach. He said he wanted to ride at Greymouth.

Reasons for Penalty:

The breach is mid-range. Mr Johnson has shifted abruptly across the field when not clear. Two horses have suffered interference. The Committee takes a starting point of 5 days’ suspension and a fine of $500 as in the Revised Guidelines. A credit of one day is given for the Respondent’s good record when the large number of rides he has had this season is taken into consideration and his admission of the breach.
