Facts:
After the determination of an earlier protest in Race 5, the GALLAGHER FAMILY GOLD CUP/ FLOORING XTRA PACE, an information was lodged by Mr Allison under 870(5) alleging that horse No 4 HOLM THREE (H Hunter), which was placed 2nd as a result of a promotion by the Committee, broke over the concluding stages when it was lapped on by LEONARDO and HIGHLAND REIGN.
Rule 870(5) states:
Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869(8)) such relegation of the horse shall be at the discretion of the Judicial Committee.
Submissions for Decision:
At the previous protest hearing we found that HOLM THREE broke from its gait and galloped some 30 metres to the winning post. While the horse was still in a gallop when it crossed the line and was lapped on by LEONARDO and HIGHLAND REIGN, this was due to HOLM THREE suffering interference through the inwards movement of MCCOVEY COVE. Relegation in these circumstances is at the discretion of the Committee.
Reasons for Decision:
We are satisfied that had HOLM THREE not received interference it would not have broken from its gait. We consequently exercise our discretion and dismiss the protest.
