Facts:

Following the running of Race 8, the Biofeed and The Agriculture and Country Jewel Handicap 65 2200, an Information was filed by Stipendiary Steward Mr M Davidson against class A rider Mr T Moseley alleging that he had angled his mount Perfecto outwards when not sufficiently clear of Knutquacker, (K Mudhoo) near the 1100 metres.

Mr Moseley was present at the hearing and he confirmed he understood the rule and he indicated he admitted the breach.

Rule 638 provides as follows:

(1)-A rider shall not ride a horse in a manner which the Judicial Committed considers to be

Mr Davidson had Chief Stipendiary Steward Mr J Oatham, show the available video replays of the incident near the 1100 metre mark of the 2200 metre race.

Mr Oatham pointed out that Mr Moseley was about three quarters to a length clear of Knutquacker, when moving outwards, at about the 1100 metre mark, checking Knutquacker (K Mudhoo).

Mr Oatham said the outward movement was at the low end of carelessness, and if Mr Moseley had waited another stride or two he would have been clear.

Mr Moseley agreed with Mr Oatham's summation of the incident stating he had made a minor error of judgement.

Submissions for Penalty:

Mr Davidson said that Mr Moseley was a very busy, successful senior rider. He has had two breaches of careless riding over the last twelve months, 1 February at the Otago Racing Club, 5 National Riding Days suspension and the South Canterbury Racing Club, 9 October 2020 (6 National Days).

Taking into account Mr Moseley’s record, his early admission of the breach, and the low range of carelessness, the stewards were submitting that a 4 National Riding Days suspension was an appropriate penalty. Mr Davidson also noted the Canterbury Jockey Club Premier 3 day meeting commences on 7 November 2020 where Mr Moseley would be in some demand.

Mr Moseley sought a deferment of suspension until after 29 October (Ashburton Meeting) where he had confirmed rides at this meeting. He also confirmed that the Canterbury Jockey Club Premier Meeting was a major opportunity.

Reasons for Penalty:

The Committee agrees with the assessment of the stewards, that the degree of carelessness in this case, was at the low end of the range. For the purposes of fixing penalty, the low range penalty guide starting point is six National Riding Days.

Mr Moseley is a very busy senior rider with up to eight or nine mounts per meeting.

His frank admission of the breach, and also the fact that the breach was at the very low end of carelessness, Mr Moseley has been given a reduction of 2 riding days.

The fact also the Canterbury Jockey Club premier 3 day meeting commencing on 7 November, was also considered by both the Stewards in submissions, and the Committee in fixing penalty.
