Facts:

R. Cully, the rider of ‘O’Connor’ allowed his mount to shift in near the post on the first occasion dictating ‘Starzeen’ (P. Oakden) into the line of ‘Bally Heights’ (T. Flint) which was checked.
 
Stipendiary Steward, N. Goodwin, using the available films the incident in which the horse ridden by R. Cully shifted inwards causing two horses to be checked as the charge was admitted, the charge was deemed to be proven.

Mr. N. Goodwin informed the committee he viewed the breach to be in the midrange. Mr. Cully has had as of today 216 rides and has never been charged. He felt his record and the admittance of the breach should be taken into account and felt a period of suspension of 2 days be imposed to allow Mr. Cully to ride on McGregor Grant steeplechase day on the 6th of June.

Mr. Cully had no comment but did confirm he rode only over jumps and in highweights and that he was classed as a national rider.

Reasons for Penalty:

In coming to our decision to impose a period of suspension for this breach Mr. Cully we have started from a base of 5 days and reduced accordingly to take into account your admittance and your very good riding record.

We did note Mr. Goodwins submission on a suggested period of suspension of 2 days to allow you an opportunity to ride in a prestige jumping race. However, we are of the opinion that your breach of the careless riding rule, while it could be classed in the mid range, did effect two horses, one of which had to be taken hold of and change ground. Therefore we could not concur with that part of Mr. Goodwins submission.
