Facts:

Following the running of Race 3 (Maneline Farrier Supplies Mobile Pace) Information No. A10269 was filed with the Judicial Committee. It was alleged by the Informant that Mr Doody used his whip more times than is permitted (10) when driving MADIBA inside the final 400m.

Mr Mulcay advised the Committee that Mr Doody had seen the film replays, admitted the breach and did not wish to attend the hearing. The Information was endorsed accordingly.

Mr Mulcay identified horse and Driver on the film replays and said that Mr Doody had hit his horse 16 times inside the final 400m of the event.

Submissions for Penalty:

Mr Mulcay said that Mr Doody had a good record under the Rule. He said that the JCA Penalty Guideline starting point for 16 strikes would be considered as a suitable penalty.

Submissions on Penalty could not be heard from Mr Doody as he had elected not to be present at the hearing.

Reasons for Penalty:

On reviewing the films the Committee was satisfied that Mr Doody had breached the Rule and whip regulations when hitting his horse 16 times between the 400m and the winning post. Taking all matters concerning the breach into consideration it was the determination of the Committee that there was not any reason to depart from the JCA Penalty Guideline starting point of a fine of $300.
