This Committee orders that Mr Nason’s Rider’s License is suspended from the conclusion of racing today up to and including racing on the 26th of January 2014. This means that Mr Nason will miss Meetings at Te Rapa, Rotorua, Wellington and Auckland.
Facts:
Following the running of Race 8, the FLOORING HQ 1600 an Information was lodged by Stipendiary Steward Mr MJ Williamson against apprentice Jockey Mr J Nason pursuant to Rule 638(1)(d) alleging Mr Nason allowed his mount to shift out over the final 250 metres hampering ARIZONA JAZZ on several occasions with ARIZONA JAZZ having to steady and thereby lose ground.
Mr Nason was present and he was assisted by his employer, Licensed Trainer Mr M Donoghue.
Mr Nason advised this Committee that he admitted the breach.
Stipendiary Steward Mr W Robinson on behalf of Mr Williamson demonstrated the incident by use of the Race Films. These showed that when the horses were in the home straight, SACRED PARK ridden by Mr Nason was racing wide on the outside of the field with ARIZONA JAZZ ridden by Mr M Hills outside it. Mr Nason continued to ride his horse with the whip and it ran out even further for quite a distance in the straight and in doing so pushed ARIZONA JAZZ wider. This resulted in Mr Hills having to take corrective action and restrain his horse to behind SACRED PARK and then try to make ground on the inside of it.
Mr Robinson said that Mr Nason did not make any attempt to straighten his horse nor did he stop riding.
Mr Donoghue acknowledged the evidence as presented.
Submissions for Penalty:
Mr Williamson said that Mr Nason had only been riding in New Zealand for a short time and in fact this was his 9th or 10th ride. He has a clear record and has been very cooperative with the Stewards and has of course admitted the breach.
Mr Williamson said that the incident was at the low end of the scale of seriousness and that any penalty should reflect the mitigating factors.
Mr Williamson also said that Mr Nason was a North Island Rider.
Mr Donoghue said that Mr Nason was attached to their stable and would be leaving New Zealand again in about three weeks time. He said that Mr Nason had ridden his first winner earlier in the programme today and that he was trying very hard to do his best on SACRED PARK.
Mr Nason said that he had ridden for one season in England and he confirmed that he was trying very hard to do his best with SACRED PARK and at the time he did not realize that the horse was running out so much.
We have advised Mr Nason that he is entitled to have any suspension deferred for seven days but he has told us that he would like it start immediately.
Reasons for Penalty:
The incident is clearly shown on the films that we have viewed and did show SACRED PARK running wide in the straight and then continue to run wider under a ride from Mr Nason. This inconvenienced ARIZONA JAZZ which had to be restrained and then go on the inside of SACRED PARK.
We agree with Mr Williamson however that this matter is at the lower end of the scale of seriousness and we have taken into account the mitigating factors put forward to us. This is reflected in the penalty.
The starting point penalty is suspension of license for five days but we believe that four days is appropriate. We have not taken into account the Wellington Racing Club’s Meeting on the 20th of January 2014 because Riders are already declared for that Meeting.
We are also grateful to Mr Williamson for advising us that Mr Nason is a North Island Rider only.
