Facts:
Following the running of R5 (Busy Bees Cleaning 1400), Information No. A6960 was filed with the Judicial Committee. It was alleged that Mr Lammas failed to ride his mount I’M BRONSON out to the finish of the race when there was a chance of the horse finishing in a better placing.
Rule 636(1)(d) provides:
A person being the rider of a horse in a race, must ride his horse out to the end of the race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared.
Mr Lammas acknowledged that he understood the rule and confirmed to the committee that he admitted the breach.
Mr Coles showed the film replay and identified the horse I’M BRONSON passing the 400m, when racing approximately 3 lengths in arrears of I’M ALL EARS. He then identified that Mr Lammas relaxed his ride and over the concluding stages his horse clearly made ground on I’M ALL EARS without any urging. He advised the committee that I’M ALL EARS finished in 5th placing, a half-head in front of I’M BRONSON. He added that in the Stipendiary Stewards' opinion there was a reasonable chance of I’M BRONSON running into 5th position.
Mr Lammas acknowledged that he did sit up on his mount and said that he misjudged the situation and said that I’M ALL EARS was stopping quickly as opposed to his horse finishing on.
Submissions for Penalty:
Mr Oatham said that Mr Lammas was riding with vigour around the turn but then eased up. He said that Mr Lammas needed to be aware of his obligations in a small field given the ground that his mount took off I’M ALL EARS over the concluding stages. He said an aggravating factor was that Mr Lammas had breached the rule in February of this year when he eased his mount and lost 5th position and incurred a $200 fine. He said that the owners of I’M BRONSON potentially lost $500 in prize money for 5th placing. He added that a fine would be an appropriate penalty with an uplift from the previous penalty and submitted a fine of $350 - $500 would be suitable on this occasion.
Mr Lammas again confirmed that he misjudged the situation and said that he would prefer a lighter penalty given that he had admitted the breach.
Reasons for Penalty:
The JCA penalty guidelines provide for a sliding scale for these types of breaches and we noted that for failing to ride out for 5th placing, the starting point is $300. The only mitigating factor on this occasion was the admittance of the breach.
In the committee’s view Mr Lammas’ mount made up approximately 4 lengths over the concluding stages without any vigour being demonstrated by Mr Lammas. The committee believed that a further aggravating factor is that the owners of the horse were denied the opportunity of receiving $500 in prize money.
